Licence amendments
Following Public Notice CRTC 1995-197 dated 23 November 1995, the Commission approves the application by Radio MF Charlevoix inc., licensee of the radio programming undertaking CIHO-FM Saint-Hilarion and its transmitters CIHO-FM-1 La Malbaie and CIHO-FM-2 Baie-Saint-Paul, to amend its licence in order to be relieved of the current commitments set out in its Promise of Performance to operate in a Group I format. It is therefore a condition of licence that this station not be operated within the Specialty format as defined in Public Notice CRTC 1995-60, as amended from time to time by the Commission.
Moreover, the Commission approves in part the application announced in Public Notice CRTC 1995-214 dated 13 December 1995 to amend this undertaking's licence. The Commission approves that part of the application requesting relief from commitments to broadcast a minimum level of news programming. However, the Commission denies that part of the application requesting relief from the commitments establishing a minimum level of spoken word programming and maximum amounts of advertising. The Commission notes that the licensee has failed to provide any justification in support of this application, as would be required of CIHO-FM given the particular circumstances of its community mandate. The Commission considers that approval of this aspect of the application would have an undue impact on the ability of the station to meet its responsibilities to the community.
The Commission reminds the licensee that it is required to refrain from soliciting advertising on the south shore of the St. Lawrence River. The licensee is also reminded that, while CIHO-FM is licensed as an independent FM broadcasting undertaking, it is essentially a community-owned and community-oriented station.
This decision is to be appended to the licence.
