Licence renewals
Following Public Notice CRTC 1996-25 dated 20 February 1996, the Commission renews the Class 2 (fewer than 2,000 subscribers) licences held by Westman Media Co-operative Ltd. (Westman), for the cable distribution undertakings serving the above-noted communities, from 1 September 1996 to 31 August 2003.
With the exception of the requirements stipulated in section 23 of the Cable Television Regulations, 1986 (the regulations), the operation of these undertakings is regulated pursuant to Parts I, III and IV of the regulations and the licences will be subject to the conditions in effect under the current licences as well as to those conditions specified in this decision and in the licences to be issued.
It is a condition of each licence that the licensee be relieved of the requirement of section 4 of the regulations to own and operate the amplifiers and the outside wiring portion of the subscriber drops. With respect to the undertakings serving Carberry, Minnedosa, Neepawa and Rivers, it is a also condition of licence that the system share in the joint use of a distant head end located at Tolstoi, Manitoba.
With respect to the undertaking serving Melita, the Commission approves the licensee's application to be relieved, by condition of licence, from the requirement of paragraph 22(1)(a) of the regulations that it distribute CKX-TV-2 (CBC) Melita, a local programming service, due to the poor quality of the signal. The licensee will distribute instead CKX-TV Brandon.
With respect to the undertaking serving Gladstone, the Commission also approves the licensee's application to be relieved, by condition of licence, from the requirement of paragraph 22(1)(b) of the regulations that it distribute CKX-TV-3 (CBC) McCreary, a regional programming service, due to the poor quality of the signal. The licensee will distribute instead CKX-TV Brandon.
The Commission acknowledges an opposing intervention to the renewal application of the undertaking serving Rossburn, wherein the intervener noted that there are no French-language television services and, in particular, no French-language CBC service distributed in Rossburn.
The Commission notes that as a Class 2 undertaking (fewer than 2,000 subscribers), this undertaking is required, under the regulations, to distribute local and regional television services and that there are no French-language local or regional services available in Rossburn. The Commission notes that Westman indicated, in response to the intervention, that it has undertaken negotiations to link communities, thus making more services available to subscribers. The Commission notes that Rossburn could then be linked with communities such as Russell, Sandy Lake and Shoal Lake, and thus have access to CBWFT Winnipeg or CBFT Montréal.
This decision is to be appended to each licence.
