 Acquisition of assets and new native radio programming undertaking
Following a Public Hearing in Vancouver beginning on 27 February 1996, the Commission approves the application by Osakdo Communications Society for authority to acquire the assets of the transmitter VF2189 Saddle Lake from Aboriginal Multi-Media Society of Alberta (Aboriginal), and for a broadcasting licence to carry on an English- and Native-language FM radio programming undertaking at Saddle Lake, operating on the frequency 89.9 MHz, channel 210LP, with an effective radiated power of 10 watts.
 Based on the evidence filed with the application, the Commission has no concerns with respect to the availability or the adequacy of the required financing.
 Consistent with Public Notice CRTC 1990-89 dated 20 September 1990 entitled "Native Broadcasting Policy" (the policy) and subject to the requirements of this decision, the Commission will issue a licence for a Type A FM native radio undertaking, upon surrender of the current authority for VF2189 held by Aboriginal. This licence will expire on 31 August 1999, and will be subject to the conditions specified in the licence to be issued.
 The licence term granted herein, while less than the maximum of seven years permitted under the Broadcasting Act, will enable the Commission to consider the renewal of this licence in accordance with the Commission's regional plan for native radio undertakings across Canada and to better distribute the workload within the Commission.
 The Commission notes that the applicant has requested that it be granted status as a Type A native station, even though under the policy, its proximity to CHLW St. Paul would establish this station as a Type B native station.
 In approving this request, the Commission has taken into account the fact that the station will be operated as a low-power undertaking and will not compete directly with the near-by commercial station CHLW St. Paul in view of its distinctive language offering and native program orientation.
 The Commission notes that the applicant will broadcast 30 hours per week of local programming, of which 10 hours will be in the Cree language. For the remaining hours, the station will rebroadcast the programs of CFWE-FM Lac La Biche.
 The applicant is reminded of the requirements for Canadian musical selections set out in the Radio Regulations, 1986.
 This decision is to be appended to the licence.
