As the request from ASN can have an effect on NTV, the Commission will wish to discuss this question with NTV and ASN at the hearing.

Application (941318800) by CHUM LIMITED:
a) to renew the broadcasting licence of the (satellite to cable) programming undertaking known as Atlantic Satellite Network (ASN) expiring 31 August 1995; and
b) to amend the broadcasting licence by deleting the condition of licence that the licensee not solicit local advertising in the Halifax-Dartmouth area.
The licensee notes that it is required to adhere to the Television Broadcasting Regulations, 1987, by condition of licence, and considers the ASN service as a conventional television service. It is therefore requesting the Commission that all cable undertakings that are subject to Section 20 of the Cable Television Regulations, 1986 (Substitution of Identical Programming Services), be required to include ASN among those television services eligible for substitution.
Also, the licensee is requesting the removal of the condition of licence requiring that commercial messages which are likely to have a negative financial impact on Newfoundland Broadcasting Company Limited (NTV) be deleted from the ASN services distributed by Cable Atlantic Inc. at St. John's.
The Commission will wish to discuss these matters at the public hearing with the licensee.

Applications have been received from the partners of The Sports Network (TSN), the partners of Le Réseau des Sports (RDS) and the partners of Viewer's Choice Canada requesting Commission authority for a proposal put forward by the John Labatt Group of companies to restructure its organization. The proposal contem-plates the transformation of certain partnerships into corporations. This exercise is also expected to produce a more simplified ownership structure for the Labatt Group's regulated businesses and will not affect the ultimate direct effective control of any of the undertakings.

(a corporation to be incorporated), for authority to acquire the assets from the partners of TSN and for a broadcasting licence to continue the operation of the national English-language specialty programming undertaking, upon surrender of the current licence issued to the partners of TSN, being Labatt Brewing Company Limited and Labatt Communications Inc., under the same terms and conditions as the current licence.
As a result of the restructuring, the direct effective control of the licensee will reside with Labatt Communications Inc. which is a wholly-owned subsidiary of the Labatt Brewing Company Limited.
B. Application (941936700) by LABATT COMMUNICATIONS INC. for authority to acquire the assets from Labatt Brewing Company Limited and Labatt Communications Inc. (the partners of TSN Enterprises) and for a broadcasting licence to continue the operation of the English-language pay television undertaking engaged in the distribution of Pay-Per-View service, upon surrender of the current licence issued to the partners of Viewer's Choice Canada, being TSN Enterprises, Rogers Pay-Per-View Inc. and First Choice Canadian Communications Corporation, under the same terms and conditions as the current licence.
As a result of the restructuring, the minority interest in the licensee that was previously held by TSN Enterprises will reside with Labatt Communications Inc.
C. Application (941398000) by LABATT COMMUNICATIONS INC. on behalf of 3064590 Canada Inc. (a corporation to be incorporated), for authority to acquire the assets from the partners of Le Réseau des Sports (RDS) and for a broadcasting licence to continue the operation of the national French-language specialty programming undertaking, upon surrender of the current licence issued to the partners of RDS, being Labatt Brewing Company Limited and TSN Enterprises, under the same terms and conditions as the current licence.
As a result of the restructuring, the direct effectif control of the licensee will reside with Labatt Communications Inc. which is a wholly-owned subsidiary of Labatt Brewing Company Limited.
