The Commission has received the following application:
ONTARIO REGION

Application (951193200) by FAIRCHILD TELEVISION LTD. (FAIRCHILD) to amend the broadcasting licence to carry on the national Chinese-language specialty programming undertaking by changing condition of licence #3 which reads as follows:
3. Commencing 1 September 1995 and during each of the last four semesters of its licence term, the licensee shall devote to the broadcast of Canadian programs not less than:
(i) 60% of the time from 7:00 p.m. to 10:00 p.m., and
(ii) 40% of the total hours devoted to all programming.
Fairchild is seeking to amend the above condition of licence by reclassifying the current "Prime Time" from 7:00 p.m. - 10:00 p.m. to 6:00 p.m. - 11:00 p.m. and to reduce the attendant percentages of times devoted to Canadian programs. The proposed new condition of licence is as follows:
3. Commencing 1 September 1995 and during each of the last four semesters of its licence term, the licensee shall devote to the broadcast of Canadian programs not less than:
(i) 40% (or a minimum of 14 hours weekly) of the time from 6:00 p.m. to 11:00 p.m., and
(ii) 30% (or a minimum of 29 hours weekly) from 6:00 a.m. to midnight.
As part of the rationale for the proposed amendments, Fairchild submits that, during the 1993 public hearing into its acquisition of Chinavision, Fairchild officials miscalculated the amount of Canadian programming contained in the proposed program schedule. Furthermore, Fairchild submits that the proposed changes will "... allow for the flexibility in strengthening the prime time local programming by allowing it to be scheduled at times which maximize audience, without jeopardizing the balance between foreign and local programming..."
