Proposal to amend the "8 out of 10" point count criterion for funding from the Cable Production Fund, in respect of its application to treaty co-productions

Application (951614700) by NEWCAP INC. to amend the (radio) programming undertaking licence of CJLB-FM by changing the transmitter location from the site approved by the Commission in Decision CRTC 94-842 to a new site located northeast of Thunder Bay at Mount Baldy. It is also proposed to upgrade channel 287 from Class C1 to Class C.

The Commission notes that the station's authorized coverage contours will be enlarged due to a proposed increase in the height of the transmitting antenna. The licensee states these changes will result in a better signal reception for the CJBL-FM listeners.

Application (952871200) by VISION TV: CANADA'S FAITH NETWORK/RÉSEAU RELIGIEUX CANADIEN (Vision TV) to amend its broadcasting licence to carry on a national English-language specialty programming undertaking providing interfaith religious programming, by amending that portion of its Code of Ethics and Program Practices pertaining to solicitation of funds that is referenced in condition of licence 9(e).

Where it pertains to the solicitation of funds, the amended code would read at Section 6 as follows:

In accordance with its Conditions of Licence, VISION TV upholds the following definitions:
|
a) "Solicitation" - Solicitation consists of direct appeals to viewers for financial gifts of cash, cheques, money orders, credit cards or electronic and other means of transferring funds; for example where the primary objective is to raise revenues to sustain broadcast of the program. Alternatively, the issuing of a charitable tax receipt, under applicable laws, will represent a further test of when a program is deemed to be a solicitation.

i) On-air solicitation will be allowed for a period of 90 seconds each half hour and may not be accumulated.
|
ii) The wording and tone of presentation of such solicitations on air or in corresponding printed matter will in no case place an undue responsibility on the viewer to respond to the appeal, be unduly alarmist in suggesting that the program may be discontinued in the absence of such response, predict any negative divine consequences as a result of not responding, or exaggerate the positive results of responding.

iii) Where a 1-900 or toll charge phone number or other fee-based method of electronic transmission is being used to elicit viewer response, there must be displayed on screen along with the phone number, the estimated cost per order or call and cost per minute of additional time. The message should be at least as large as the message making the offer. The word "FREE" may not be used in conjunction with a service that charges a toll or fee.

iv) Organisations soliciting funds must be able to substantiate that the funds are being directed to the causes for which they are raised, in compliance with Revenue Canada regulations.
|
v) "Special Charitable Appeals" - No programs in which the primary purpose is the raising of funds, for whatever reason, can be broadcast without the authorisation of the Board of Directors of VISION TV.
|
It it also proposed that the text of condition of licence 9(e) be amended in order to add wording to provide that the Code of Ethics and Program Practices will henceforth be one that is "as amended from time to time and approved by the Commission".
