Proposed Amendments to the Pay Television Regulations, 1990
|
Attached is a copy of proposed amendments to the regulations noted above. Paragraphs 3(2)(e) and (f) of the existing regulations prohibit the distribution of programming, other than filler programming, that is produced by the licensee or a person related to the licensee. The proposed amendments will allow licensees of pay television programming undertakings to apply to vary, by condition of licence, the application of the prohibition set out in paragraphs 3(2)(e) and (f). The amendments will also clarify the meaning of "relatedî for the purposes of these regulations.

The Commission proposes that, where a licensee seeks a condition of licence to vary the application of the prohibition against the distribution of programming produced by itself or by a related person, the onus will be on the licensee to demonstrate, among other things, adequate safeguards to ensure fair access by independent producers.

Parties wishing to comment on the proposed amendments must send their submissions to the Secretary General, CRTC, Ottawa, Ontario, K1A 0N2, by 15 January 1996. While receipt of submissions will not be acknowledged, they will be considered by the Commission and will form part of the proceeding.
