CALL FOR COMMENTS ON REQUESTS TO AMEND THE DISTRIBUTION AND LINKAGE REQUIREMENTS AND THE PART II LIST OF ELIGIBLE SATELLITE SERVICES
The Commission has received requests by Shaw Communications Inc. (Shaw) and Rogers Cablesystems Limited (Rogers) for amendments to the Commission's existing Distribution and Linkage Requirements. These requirements were set out in Public Notice CRTC 1994-60 dated 6 June 1994. The proposed amendments would permit the new Canadian specialty services (i.e. those provided by specialty service programming undertakings licensed on or after 6 June 1994) to be packaged with the services of Black Entertainment Television (BET) and any one of the six U.S. superstations contained in Section B of the Part II List of Eligible Satellite Services. This would be in addition to any of the services with which they may be packaged under the existing Distribution and Linkage Requirements.
The Commission has also received a request from Access Cable Television Limited (Access) to have BET added to Section A of the Part II List of Eligible Satellite Services.
Shaw and Rogers made a further request concerning the service known as Consumer News & Business Channel (CNBC). This is a non-Canadian satellite service that cable operators are currently authorized to include as part of a discretionary package, subject to the restriction that they only distribute the 6:00 a.m. to 7:00 p.m. weekday programming component of the service. Shaw and Rogers requested that this restriction be removed when CNBC is packaged in a tier that includes any of the new Canadian specialty services. Thus, CNBC could be distributed on a full-time basis when packaged in association with the new Canadian specialty services.
As submitted, implementation of the proposals by Shaw and Rogers would require amendments, not only to the Distribution and Linkage Requirements, but also to the Cable Television Regulations, 1986. The Commission notes, however, that the proposals could also be implemented by simply amending the Part II List of Eligible Satellite Services. For example, BET and the six superstations could be moved to Section A of the Part II List of Eligible Satellite Services, but with the stipulation that they be linked only with pay television services or with the new Canadian specialty services.
The Commission hereby invites public comment on the above proposals and, should they be accepted, on how best to implement them. Comments should be addressed to Allan J. Darling, Secretary General, CRTC, Ottawa, Ontario, K1A ON2 and should be received no later than 30 October 1995. While receipt of submissions will not be acknowledged, they will be considered by the Commission and will form part of the public record of the proceeding.
