Public Notice CRTC 1995-143
The Commission has received applications by SAUGEEN TELECABLE LIMITED, 111 - 7th Avenue, Hanover, Ontario, N4N 2G8, to be permitted, by condition of licence, to alter the signals of U.S. satellite services for the insertion of promotional material in certain of the local availabilities of those services. U.S. cable companies may insert their own advertising or promotional material. Since this time is also available to Canadian cable operators, Saugeen is proposing to use this opportunity for strictly promotional purposes, not for the sale of advertising.
The applicant has agreed to the imposition of the following condition of licence, in conformity with that imposed on Rogers Cable TV Ltd. in Decision CRTC 95-12:
"The licensee may, at its option, insert certain promotional material as a substitute for the "local availabilities" (i.e. non-Canadian advertising material) of non-Canadian satellite services. At least 75% of these local availabilities must be made available for use by licensed Canadian programming services for the promotion of their respective services, for the promotion of the community channel and for unpaid Canadian public service announcements. A maximum of 25% of the local availabilities may be made available for the promotion of discretionary programming services and packages, customer service information, channel realignments, cable FM service and additional cable outlets."
The applicant guarantees to provide Canadian programming services access to local availabilities on a nondiscriminatory basis at no cost. No programming service would receive preferential treatment.
