Telecom Order CRTC 95-951
IN THE MATTER OF an application by Bell Canada (Bell), dated 27 June 1995, under Tariff Notice 5523, for approval of a revision to the definition of "Customer" in Bell's General Tariff.
WHEREAS, in its application, Bell provides a list of entities which are intended by the company to be included in the proposed definition;
WHEREAS the Commission notes that the proposed definition of "customer" in the Tariff Notice is very broad, and considers that it is not apparent that the proposed tariff revision adequately reflects the company's intention, as described in the letter of application that accompanied the Tariff Notice;
WHEREAS the Commission considers that it should be clear from the company's General Tariff itself whether a particular entity falls within the definition of a "customer";
WHEREAS the Commission further notes that in recent months there have been a number of disputes that raise issue of what constitutes a customer in the territories of several Stentor members, including BC TEL, whose General Tariff currently contains the wording proposed by Bell;
WHEREAS the Commission agrees with Bell that it is desirable to have a definition of "customer" that is common to all Stentor members; and
WHEREAS the Commission intends to issue, in the near future, a Public Notice seeking comment on the appropriate definition of "Customer" -
IT IS HEREBY ORDERED THAT:
The proposed tariff revision submitted by Bell under Tariff Notice 5523 is denied.
