a) for authority to acquire the assets and for a broadcasting licence to continue the operation of the (radio) programming undertaking CHER Sydney, upon surrender of the current licence issued to Radio Cape Breton Limited under the same terms and conditions as the current licence; and
b) for a broadcasting licence to carry on an English-language FM (radio) programming undertaking at Sydney, operating on a frequency of 102.3 MHz (channel 272 C) with an effective radiated power of 61,000 watts, upon surrender of the licence to be issued to CHER Sydney, if the Commission approves application (950171900) by Celtic Broadcasting Limited to acquire the assets of CHER Sydney.
The Commission notes that an approval of the authority sought in (a), noted above, would result in the applicant owning two AM radio stations of the same language in the same market, whereas an approval of the proposal described in (b) would give the applicant two FM radio stations of the same language in the same market. Either scenario is contrary to the Commission's policy on the ownership of broadcasting undertakings, and the applicant will be expected to convince the Commission that, in this case, an exception to the policy is justified.
The Commission will only proceed with this application at the public hearing if advised by the Department of Industry, Science and Technology, at least ten days prior to the hearing, that it is technically acceptable.
