Licence amendments related to station format

In Public Notice CRTC 1995-149 dated 30 August 1995, the Commission announced applications submitted by various licensees in response to the Commission's announcement in Public Notice CRTC 1995-60 entitled "A Review of Certain Matters Concerning Radio". In that public notice, the Commission announced that it would be prepared to revise the format system by relieving the licensees of commercial FM stations of their respective Promise of Performance commitments to operate their stations in Group I "Pop, Rock, and Dance" or Group II "Country". At the same time, the Commission announced that it would retain a "Specialty" format.

The Commission approves all of the applications by the licensees of commercial FM stations listed in the appendix to this decision, to amend their licences in order to be relieved of the current commitments set out in their respective Promises of Performance to operate in a Group I or Group II format. Accordingly, the Commission replaces those commitments by the following condition:

It is a condition of licence that this station not be operated within the Specialty format as defined in Public Notice CRTC 1995-60, or as amended from time to time by the Commission.

An intervention in opposition to the application by Rawlco (Alberta) Ltd. (Rawlco) was submitted by Redmond Broadcasting Inc. (Redmond). Redmond stated that the Commission's Public Notice CRTC 1995-60 solicited applications only from stations currently operating. It also pointed out that the station had been first licensed in 1994, and that it is the Commission's practice that licensees should complete at least one full term before obtaining relief from obligations. It added that the impact on the Calgary market had been minimized by the applicant's 1994 commitment to opeate in Group I.

In response to the intervention, Rawlco stated that Public Notice CRTC 1995-60 did not distinguish between new and established stations and did not preclude new stations from flexibility. It also responded that established stations should not be granted the advantage of format flexibility over new entrants.

The Commission is satisfied with the licensee's reply to the intervention and is not convinced that there is a compelling reason in this case to distinguish between "currently operating" and "established" stations.
