Acquisition of assets
Following a Public Hearing held in the National Capital Region on 18 September 1995, the Commission approves the applications for authority to acquire the assets of the cable distribution undertakings serving the above-mentioned localities from Trillium Cable Communications Limited, and for broadcasting licences to continue the operation of these undertakings.
Upon surrender of the current licences, the Commission will issue licences to 1110761 Ontario Inc., expiring 31 August 1996 in the case of the undertakings serving Millbrook and Lakefield/Bridgenorth, expiring 31 August 1998 in the case of the undertakings serving Bancroft, Barry's Bay, and Whitney, and expiring 31 August 2000 in the case of the undertakings serving Calabogie, Kemptville, Lanark, Perth and Smiths Falls. The above-noted dates are the expiry dates of the current licences.
The operation of the Perth and Smiths Falls undertakings will be regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations) while the operation of the undertakings serving Bancroft, Barry's Bay, Calabogie, Kemptville, Lanark, Lakefield/ Bridgenorth, Millbrook and Whitney will be regulated pursuant to Parts I and III of the regulations with the exception of the requirements stipulated in Section 23. The authority granted herein is subject to the same conditions as those in effect under the current licences, as well as to any other condition specified in the licences to be issued.
In approving these applications, the Commission has taken into account the fact that 1110761 Ontario Inc. is a wholly-owned subsidiary of Trillium Cable Communications Limited and that the transaction thus represents an intra-corporate reorganization without any change occurring in the effective control or management of the licensee.
