Correction
The Commission hereby corrects the appendix to Decision CRTC 95-69 dated 28 February 1995, in order to reflect the Commission's determinations with respect to expenditures on Canadian programs and exhibition of Canadian programs, as set out in the text of the decision. The Commission therefore adds, to the definitions set out in the appendix to the decision, the following:
 "expend on acquisition" means
 (a) expend to acquire exhibition rights for the licensed territory, excluding overhead costs;
 (b) expend on script and concept development, excluding overhead costs; or
 (c) expend on the production of filler programming, as defined in section 2 of the Pay Television Regulations, 1990, including direct overhead costs
  and "expenditure on acquisition" has a comparable meaning.
The Commission notes that to the extent that expenditures proposed for closed captioning are clearly identified in the licensee's Promise of Performance as being part of Canadian programming expenses, it is not necessary to add closed captioning to the definition of "expend on acquisition".
As a result of this change, the Commission deletes the definition of "acquisition".
In addition, the Commission replaces the definition of "new Canadian production" with the following:
 "new Canadian production" means:
 a) a first-run Canadian dramatic or children's production
i) which exceeds 75 minutes in duration and in relation to which all financial expenditures made by the licensee were made prior to the commencement of principal photography or taping and in which principal photography or taping was completed after 1 January 1985; or
ii) which exceeds 22:30 minutes in duration and in relation to which all financial expenditures by the licensee are made prior to the completion of principal photography or taping, and
 b) which qualifies as Canadian content in accordance with the criteria for Canadian program recognition set out in the appendix to Public Notice CRTC 1984-94 dated 15 April 1984.
The Commission further corrects condition of licence number 4b) by changing 9:00 p.m. to 10:00 p.m.
