Decision

Ottawa, 13 January 1995
Decision CRTC 95-6
CF Cable TV Inc.
Parts of Montréal and Laval, Quebec - 940824600
Licence renewal
Following a Public Hearing in Montréal beginning on 11 October 1994, the Commission renews the Class 1 licence held by CF Cable TV Inc., for the cable distribution undertaking serving parts of Montréal and Laval, from 1 September 1995 to 31 August 2001. The licence term granted herein, while less than the maximum of seven years permitted under the Broadcasting Act, will enable the Commission to consider the renewal of this licence in accordance with the Commission's regional plan and to better distri-bute the workload within the Commission.
The operation of this undertaking is regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions in effect under the current licence, with the exception of the conditions being deleted as outlined below, as well as to those conditions specified in this decision and in the licence to be issued.
The Commission notes that the existing condition of licence with respect to the distribution of CHAI-FM Châteauguay and CKHQ-FM Kanesatake is no longer required as these signals are actually distant signals and the licensee currently distributes all local radio signals received at its local head end. In addition, the existing requirement to distribute MuchMusic and The Sports Network on an optional basis is no longer required as a result of amendments to the regulations and in view of the dual-status held by the specialty services. The licence is therefore no longer subject to conditions of licence dealing with these requiremnents.
The Commission reaffirms the particular importance it attaches to the development of community programming and has taken note of the annual budgets that will be allocated for this purpose during the new licence term. The Commission encourages the licensee to continue its efforts to develop community programs that reflect subscriber interests and concerns.
In accordance with Decision CRTC 93-13 dated 13 January 1993, the licensee is relieved, by condition of licence, of the requirement of paragraph 9(1)(c) of the regulations that it distribute the programming services of the priority television stations CFTU-TV Montréal and CJOH-TV-8 Cornwall, on the basic band of its basic service if channels are available. The licensee is still required to distribute CFTU-TV and CJOH-TV-8 as part of the basic service. Consistent with the same decision, the licensee is also authorized, by condition of licence, to continue to distribute, at its option, the two PBS stations WETK-TV Burlington, Vermont, and WCFE-TV Plattsburgh, New York.
Further, the licensee is authorized to continue distributing its special ethnic programming service. It is a condition of licence that the licensee shall not distribute as part of this ethnic service any commercial message other than a sponsorship credit, including in, or preceding or following immediately the program credits, which combines no more than the logo, name, address, the telephone number and the type of activity or profession of the sponsor. The sponsorship credit may contain sound and/or visual images, whether moving or fixed. The sponsorship credit shall have no purpose other than to acknowledge, in a concise and direct manner, the sponsor's contribution and shall at no time constitute a detailed description or promotional device.
The licensee is also authorized, on an exceptional basis, to add English- or French-language subtitles to feature films on the special multicultural programming service, provided that these subtitles are an integral part of the original production.
In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled "Implementation of an Employment Equity Policy", the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. It encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
The Commission has noted the comments included in the two interventions received and is satisfied with the licensee's response to these interventions.
Allan J. Darling
Secretary General
