Licence amendment
|
In Public Notice CRTC 1995-30 dated 23 February 1995, the Commission announced an application by Regional Cable TV (Atlantic) Inc. (Regional) to amend the licence of the cable distribution undertaking serving Fermeuse by relieving the licensee, by condition of licence, from the requirement of paragraph 22(1)(a) of the Cable Television Regulations, 1986 (the regulations) to distribute the signals of all local television stations. The licensee proposed to distribute only one local station distributing the CTV network signal, namely CJFR-TV Fermeuse.

An opposing intervention was received from a subscriber complaining about the poor quality of CJFR-TV's signal. The licensee subsequently requested that it be exempted from the requirement to carry this signal and proposed to offer CJON-TV (CTV) St. John's, received via satellite.

The Commission notes that in a report dated 25 May 1995, the Department of Industry indicated that the television signal of the CTV network received via satellite does provide a more reliable and higher quality signal to the community of Fermeuse than do the local CTV signals, CJFR-TV and CFAQ-TV Aquaforte. The Commission also notes that the licence for CFAQ-TV expires on 31 August 1995 and that, to date, no renewal application has been received from the licensee.

In view of the above, the Commission approves Regional's application, as modified. Accordingly, the licensee is relieved, by condition of licence, from the requirement of paragraph 22(1)(a) of the regulations to distribute the signals of the local television stations CFAQ-TV and CJFR-TV. The Commission notes that the licensee will distribute instead the CJON-TV (CTV) St. John's, received via satellite.

Should any of the local stations for which an exemption is granted herein, begin offering local programming, the licensee will be required to distribute the local station in question, on the basic service of its undertaking or apply to the Commission for a further exemption.
