Acquisition of assets
Following a Public Hearing in the National Capital Region beginning on 15 May 1995, the Commission approves the applications for authority to acquire the assets of the cable distribution undertakings serving Saint-Joseph-de-Beauce, Saint-Odilon and Saints-Anges, from Vidéo Québec Inc. and for broadcasting licences to continue the operation of these undertakings.
In approving these applications, the Commission has taken into account the fact that Vidéo Québec Inc. is a wholly-owned subsidiary of Télécâble Ste-Marie Inc. and that the transaction thus represents an inter-corporate reorganization without any change occurring in the control, programming or management of the licensee.
The Commission will issue to Télécâble Ste-Marie Inc. separate licences to operate the Class 2 (fewer than 2,000 subscribers) cable distribution undertakings serving Saint-Joseph-de-Beauce and Saints-Anges and the Part III undertaking serving Saint-Odilon, upon surrender of the current licences. These licences will expire 31 August 2000, the current expiry date.
The operation of these undertakings will be regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations), with the exception of the requirements stipulated in section 23 for the Saint-Joseph-de-Beauce and Saints-Anges undertakings, and the licences will be subject to the conditions specified in this decision and in the licences to be issued.
Saint-Joseph-de-Beauce
The licensee is relieved, by condition of licence, from the requirement that it distribute the priority local signal of CBVT-6 Beauceville. The licensee will distribute instead the regional signal of CBVT Quebec City.
The licensee is authorized to distribute, at its option, CFTU-TV Montréal, a distant programming service received by optical fibre from Sainte-Marie (Beauce), CHEM-TV (TVA), CKTM-TV (CBC) Trois-Rivières and CFCF-TV (CTV) Montréal, received via microwave, two special programming channels namely "Le Canal Événement" and "Arts & Spectacles" as well as WCFE-TV (PBS), WPTZ (NBC) Plattsburg, New York, WCAX-TV (CBS) and WVNY (ABC) Burlington, Vermont, received via microwave, as part of the basic service.
Saints-Anges
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized, by condition of licence, to distribute, at its option, CFCF-TV (CTV) and CFTU-TV (IND) Montréal, received via microwave, as part of the basic service.
The licensee is also authorized to distribute, at its option, two special programming channels namely "Le Canal Événement" and "Arts & Spectacles", WCFE-TV (PBS) and WPTZ (NBC) Plattsburgh, New York, as well as WCAX-TV (CBS) and WVNY (ABC) Burlington, Vermont, received via microwave, as part of the basic service.
Saint-Odilon
It is a condition of licence that the licensee be relieved of the requirement that it distribute at least four television programming services as provided for in section 23 of the regulations, so long as it distributes only those U.S. television services listed in the current application or as may be authorized by the Commission.
In Public Notice CRTC 1992-59 the Commission announced implementation
of its employment equity policy. It advised licensees that, at the time of licence renewal or upon considering applications for authority to transfer ownership or control, it would review with applicants their practices and plans to ensure equitable employment. In keeping with the Commission's policy, it encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
