Extension of the Durham Cable System - Approved
Extension of the Holstein Cable System - Denied
Following a Public Hearing held in the National Capital Region beginning on 15 May 1995, the Commission approves the application by Saugeen Telecable Limited (Saugeen) to change the licensed area for the cable distribution undertaking serving Durham by extending south along Highway 6 to Varney. The extension approved herein will add 132 potential households to Saugeen's currently authorized service area.
The competing application by Maitland Cable T.V. Limited (Maitland) to change the authorized service area for the cable distribution undertaking serving Holstein by extending it to the north along Highway 6 to Varney and by including the community of Dromore is denied.
In evaluating these applications, the Commission has taken into consideration the fact that the southern area along Highway 6 up to Varney is a more natural extension to the area currently served by the Saugeen undertaking. The Commission notes that the proposed extension is located within three kilometres of Saugeen's currently authorized service area, whereas Maitland's currently authorized service area is situated seven kilometres from the proposed extension. Moreover, the Commission notes that Saugeen made a commitment to implement service within the proposed extension area within four and one half months of the date of approval of its application. By contrast, Maitland made a commitment to implement service within the proposed extension within twelve months of an approval. As noted below, the Commission has granted Saugeen some flexibility in implementing its proposal.
The Commission notes that residents in the extended area will be able to take advantage of Saugeen's current community channel. Once all of Saugeen's systems are connected via fibre optic link, the community channel will be an enhanced service.
This approval is subject to the requirement that construction in the extended area be completed and the extended system be in operation within six months of the date of this decision or, where the licensee applies to the Commission within this period and satisfies the Commission that it cannot complete the construction and commence operations throughout the extended system before the expiry of this period and that an extension is in the public interest, within such further periods of time as are approved in writing by the Commission.
Should construction not be completed within the six-month period stipulated in this decision or, should the Commission refuse to approve an extension requested by the licensee, the authority granted shall lapse and become null and void upon expiry of the period of time granted herein or upon the termination of the last approved extension period.
