Licence amendment and aquisition of assets
Following a Public Hearing in the National Capital Region held on 21 February 1995, the Commission approves the application by Bernard Pilon, doing business under the name and style of "Télécâble Napierville Enr." (Bernard Pilon) to amend the broadcasting licence of the cable distribution undertaking serving Napierville and Lacolle by adding a local head end at Lacolle. As a result of this approval, the two communities become distinct territories and will require separate licences.
The Commission also approves the application by 2535-1438 Québec Inc. for authority to acquire the assets of the cable distribution undertakings serving Napierville and Lacolle from Bernard Pilon and for broadcasting licences to continue the operation of these undertakings.
The Commission will issue to 2535-1438 Québec Inc. separate Class 2 (fewer than 2,000 subscribers) licences to operate cable distribution undertakings to serve Napierville and Lacolle, upon surrender of the current licence, as amended. Those licences will expire 31 August 2001.
The licence term granted herein, while less than the maximum of seven years permitted under the Broadcasting Act, will enable the Commission to consider the renewal of these licences in accordance with the Commission's regional plan and to better distribute the workload within the Commission.
With the exception of the requirements stipulated in section 23 of the Cable Television Regulations, 1986 (the regulations), the operation of these undertakings will be regulated pursuant to Parts I and III of the regulations and the licences will be subject to the conditions specified in the licences to be issued.
2535-1438 Québec Inc. is a company controlled 60% by 2871483 Canada Inc. which in turn is controlled equally by Leslie Robert, Scott Davidson and Bernard Pilon.
Although the Commission does not regulate the rates of Class 2 undertakings with fewer than 2,000 subscribers, it notes that the applicant has proposed a monthly subscriber fee of $21.96.
An application (940822000) for the renewal of the licence issued to Bernard Pilon was also on the agenda of the public hearing. The Commission notes that because it has approved the acquisition of assets mentioned above, it would appear that no further action is required on the licence renewal application.
