IN THE MATTER OF an application by Co-op de téléphone de Valcourt under Tariff Notice 1 dated 8 July 1994, for approval of the introduction of various Call Management services under the title "Services Solution Co-op".

WHEREAS the Co-op de téléphone de Valcourt proposes to introduce a service which will display the number associated with the calling line;
|

WHEREAS, in Telecom Decision CRTC 92-7 Call Management Service - Blocking of Calling Number Identification, 4 May 1992 and in a letter dated 4 November 1992 addressed to AGT Limited, Bell Canada, BC TEL, Island Telephone Company Limited, Maritime Tel & Tel Limited and Newfoundland Telephone Company Limited, the Commission made various determinations with respect to the privacy measures which should accompany Number Display, Call Return and Call Trace services;

WHEREAS the Commission determined that, as a minimum, per-call blocking should be available, without charge, on request to all subscribers; per line blocking should be available, without charge, to certified shelters for victims of domestic violence and subscribers who cannot be provided with per-call blocking for technical reasons; a subscriber's line should be enabled for the use of Call Trace on request and without charge; Call Return should not function on toll calls where the calling party used call display blocking; and, where Call Return operates on local calls where the calling party used Call Display blocking, the calling number should not be revealed through the use of Call Return;

WHEREAS the Commission considers that the Co-op de téléphone de Valcourt's proposed Number Display, Call Return and Call Trace services should be offered on these terms;

WHEREAS the Commission notes that, when a call is placed through the operator with the use of the company's proposed Local Operator Assisted Dialing Service (LOADS), the called party cannot use Call Return to return the call and the Commission further notes that the company proposes a rate of $0.75 per call for the use of LOADS;

WHEREAS the company has proposed an effective date of 1 October 1994 for service introduction, but may not be in a position at that time to offer Call Return on the basis described above; and

WHEREAS the Commission considers that until the company offers Call Return on the basis described above, it would be appropriate to permit subscribers wishing to ensure that Call Return cannot be used to return their call to place calls using LOADS and to waive the $0.75 cent fee for such calls -

IT IS HEREBY ORDERED THAT:

1. The Co-op de téléphone de Valcourt is to enable a subscriber's line for the use of Call Trace without charge at the subscriber's request.

2. Until the company offers Call Return such that it does not reveal the number associated with the calling line for local calls and does not function on toll calls, the company is to waive the $0.75 per call fee associated with LOADS for calls placed using LOADS where the subscriber wishes to ensure that the Call Return feature cannot be used to return the call.

3. Subject to paragraphs 1 and 2 above, the proposed tariff revisions submitted by the Co-op de téléphone de Valcourt under Tariff Notice 1 are given interim approval.

4. The Co-op de téléphone de Valcourt must clearly advise its subscribers of the privacy implications of its Number Display, Call Return and Call Trace services and provide instructions on how to use the blocking options available to them, including the option of having the LOADS fee waived. Subscribers should be so advised through billing inserts that precede the introduction of the Number Display Service and Call Return Service as well as through the telephone directory (in the normal course of publication). Where promotional advertising is done for "Services Solutions Co-op", the availability of blocking options must be featured clearly in all such advertising (including television advertising). Where written promotional material is distributed to customers respecting "Services Solutions Co-op", the company must advise customers in the same material of the availability of blocking options and instructions on how to use these options.

5. Final approval will be granted to Tariff Notice 1 when the company advises the Commission in writing that Call Return is offered on the terms described in this Order.
