The Commission has received the following applications:
PROPOSAL BY ROGERS CABLE TV LTD. TO INSERT PROMOTIONAL MATERIAL IN THE LOCAL AVAILS OF U.S. SATELLITE SERVICES
The Commission has received applications by Rogers Cable TV Limited (Rogers) on behalf of all of the cable television undertakings controlled by Rogers (see below) to be permitted, by condition of licence, to alter the signals of U.S. satellite services for the insertion of promotional material in certain of the local avails of those services. U.S. cable companies may insert their own advertising or promotional material. Since this time is also available to Canadian cable operators, Rogers is proposing to use this opportunity for strictly promotional purposes.
According to Rogers, the promotional material will be used to enhance consumer awareness of licensed Canadian conventional, specialty, pay and pay-per-view programming services. A minimum of 50% and not more than 66% of the avails will be used for this purpose, and access by licensed undertakings will be offered on a non-discriminatory basis. The remaining avails will be used to provide customer service information, publicize CRTC renewal and rate applications, promotion of the community channel, second outlets and other cable services, and Canadian public service announcements.
Rogers has stated that "because of the nature of the proposed promotional material, it would not be traditional advertising; therefore, Rogers will not be competing with broadcasters for the sale of advertising.
In Rogers' view, potential benefits include an enhanced understanding by subscribers of the services offered by Canadian licensees and the displacement of spill-over advertising contained in the U.S. eligible satellite services.
Rogers proposes that the condition of licence be worded as follows:
"At Rogers option, Rogers may insert and distribute, via the "local availabilities" of non-Canadian satellite specialty services, material promoting the services that Rogers provides. At least 50% but not more than 66% of the "local availabilities" on non-Canadian satellite specialty services will be available for use by licensed Canadian programming services to promote their respective services. The balance of the "local availabilities" will be used by Rogers to promote cable initiatives and services including the community channel. Any unused availabilities will be made available for the broadcast of Canadian Public Service Announcements. Access to the "local availabilities" of non-Canadian satellite specialty services will be on a non-discriminatory, equitable basis for all licensed Canadian programming services which Rogers is authorized to exhibit. Access will not be unreasonably withheld as long as Rogers is provided with appropriate and relevant promotional material that meets technical specifications. and Canadian Association of Broadcasters ("CAB") guidelines."
