CALL FOR COMMENTS - PROPOSED EXEMPTION ORDER RESPECTING VIDEO GAMES PROGRAMMING SERVICE UNDERTAKINGS

On 23 March 1994, the Commission issued Public Notice CRTC 1994-34, which called for comments regarding a proposed exemption order respecting video games programming service undertakings. A total of 56 comments were received from interested parties, including representatives of the cable, television and telecommunications industries, programming undertakings and suppliers, as well as various consumer and related associations and individuals.

The Commission has reviewed in detail all the comments submitted by interested parties. In particular, the Commission has noted that a number of comments propose that video games programming service undertakings should make some form of direct contribution to the Canadian broadcasting system.

The Commission remains of the view that the creation of an exemption order remains appropriate for this class of broadcasting undertaking. At the same time, the Commission wishes to draw the attention of interested parties to subsection 3(1)(e) of the Broadcasting Act ("the Act"), which states that:

each element of the Canadian broadcasting system shall contri-bute in an appropriate manner to the creation and presentation of Canadian programming.

Therefore, in view of the requirements of subsection 3(1)(e) of the Act, as well as of subsections 3(1)(f) and 3(1)(s), the Commission herey solicits comment as to the most appropriate type of contribution that should be required of these proposed exempt undertakings. The Commission encourages interested parties, in making their submissions, to provide detailed suggestions as to what language might be added to the proposed exemption order, to serve as an appropriate criterion to address this issue of contribution.

Persons wishing to comment on this additional element of the proposed exemption order, as set out in the attachment to Public Notice CRTC 1994-34, must submit their comments to the Secretary General, CRTC, Ottawa, K1A 0N2 by 8 August 1994. While receipt of submissions will not be acknowledged, they will be considered by the Commission and will form part of the public record of the proceeding.
