REVISED LISTS OF ELIGIBLE SATELLITE SERVICES

Attached to this Public Notice are revised lists of "Part II Eligible Satellite Services" (Part II list), "Part III Eligible Canadian Satellite Services" (Part III Canadian list), and "Part III Eligible non-Canadian Satellite Services" (Part III non-Canadian list).

The Part II list (Appendix A) contains satellite services authorized for distribution by licensees holding a Class 1 licence or a Class 2 licence for an undertaking that has 2,000 or more subscribers. The Part III Canadian and non-Canadian lists (Appendix B) contain satellite services authorized for distribution by licensees holding a Part III licence or licensees holding a Class 2 licence for an undertaking that has less than 2,000 subscribers.

Country Music Television
|
Country Music Television (CMT) is a U.S. specialty service that, prior to today's notice, has appeared on the Part II and Part III lists.
|
In Decision CRTC 94-284 of today's date, the Commission approved an application by the Partners of MH Radio/Rawlco Partnership (the Partnership) for a broadcasting licence to carry on a national, English-language specialty programming undertaking to be known as The Country Network. The service will consist predominantly of videoclips of Canadian and other country music artists in performance.

At the hearing of its application in February 1994, the Partnership noted that its service would be competitive in format with the service offered by CMT. The applicant therefore requested that the Commission remove CMT from the lists of eligible services, should it approve the application by the Partnership.

It is the Commission's policy that, in cases where a Canadian service is licensed in a format competitive with that of an authorized non-Canadian satellite service, the authority for the cable carriage of the non-Canadian service could be terminated.

In Public Notice CRTC 1993-74 dated 3 June 1993 following the "Structural" hearing, the Commission announced a modification to this policy. It stated that, where it finds a non-Canadian service on the Part II list to be partially competitive with a Canadian service, the Commission may, on a case-by-case basis, elect to place the service only on Section "B" of the Part II list, for linkage exclusively with Canadian pay television services.

The Commission agrees with the Partnership that the format in which CMT operates would be competitive with the proposed format of The Country Network service. In the circumstances, the Commission has decided to leave CMT on the revised Part II list and the revised Part III Non-Canadian list attached to this notice. However, as indicated in those lists, authority for the distribution of CMT shall cease at such time as The Country Network service first becomes available to affiliates.

Authorization for the above-noted services is subject to the following:

- When this list of Part II Eligible Satellite Services is replaced by another list of Part II Eligible Satellite Services, the only authorized services will be those contained in the most recent list; accordingly, this list supersedes the list dated 9 March 1994.
|
- In the case of CANCOM signals, ASN, the CBC English- and French-language Television Services, U.S. satellite services, and any licensed pay audio programming services, licensees are required to enter into the necessary contractual arrangements for such carriage.
|
- In the case of Country Music Television, licensees may continue to distribute this service only until such time as the Canadian specialty service known as "The Country Network" first becomes available to affiliates, at which time authority for the distribution of Country Music Television shall cease.

- In the case of out-of-province educational services, there should be no objection on the part of the originating service.

- In the case of CANCOM signals, ASN, the CBC English- and French-language Television Services, and any licensed pay audio programming services, licensees are required to enter into the necessary contractual arrangements for such carriage.
|
- In the case of CFTM-TV and CHAN-TV, a licensee also distributing the signal of a local TVA/CTV affiliate shall delete the duplicate programming from the CANCOM services or substitute the local service(s) when the programming is identical.
|
- In the case of Country Music Television, licensees may continue to distribute this service only until such time as the Canadian specialty service known as "The Country Network" first becomes available to affiliates, at which time authority for the distribution of Country Music Television shall cease.
