Licence amendment

Pursuant to Public Notice CRTC 1994-84 dated 20 July 1994, the Commission approves the application to amend to licence for the cable distribution undertaking serving Saint-Jean-des-Piles with respect to the requirements of section 23 of the Cable Television Regulations, 1986 (the regulations). Accordingly, it is a condition of licence that the licensee be relieved of the requirement that it distribute at least four television programming services as provided for in section 23 of the regulations, so long as it does not distribute any U.S. television service or only those that may subsequently be authorized by the Commission.
In approving this application, the Commission has taken into account the applicant's argument that the distribution of additional English-language CANCOM services is not warranted, given that its subscribers are almost exclusively francophone. The Commission acknowledges the intervention submitted by Canadian Satellite Communications Inc. with regard to this application as well as the applicant's reply thereto.
The Commission notes that the applicant proposes to distribute The Nashville Network (TNN), which is a Part III eligible non-Canadian satellite service. This proposal is inconsistent with the applicant's argument in its request for relief from the provisions of section 23 of the regulations, in which it claims that its subscribers do not wish to receive additional English-language services. Consequently, the Commission expects the applicant either to delete TNN from its distribution list or to comply with the four-signal requirement of section 23. The applicant is required to file a report with the Commission, within three months of the date of this decision, confirming which of these two options it has chosen.
