Licence renewal and amendment for CHXL-FM
Following a Public Hearing in the National Capital Region beginning on 20 June 1994, the Commission renews the broadcasting licence for CHXL-FM Brockville from 1 September 1994 to 31 August 1997, subject to the conditions in effect under the current licence, as well as to those conditions specified in the licence to be issued.
The three-year licence term granted herein reflects the Commission's concern in light of the licensee's failure to adhere to the commitments set out in the current Promise of Performance to support the development of Canadian talent.
In this regard, the Commission estimates that the licensee's direct and indirect contributions to Canadian talent development over the first four years of the current licence term fell approximately 57% short of the amount that, according to the station's Promise of Performance, should have been allocated to this purpose during that period. In explaining this shortfall, the licensee cited, among other things, the ongoing revenue shortfalls it has experienced due largely to the fact that the station has been transmitting at reduced power ever since operations commenced in 1988.
The Commission reaffirms the particular importance it attaches to the development of Canadian talent. A three-year licence term will enable the Commission to review the licensee's financial status at an early date.
As part of its renewal application, the licensee requested an amendment to its licence which would authorize it to increase the use of hits broadcast on a weekly basis from 49.99%, the maximum level generally permitted FM licensees under the Commission's policy, to a maximum of 75%. The licensee's request is made pursuant to Public Notice CRTC 1992-3 dated 16 January 1992 and entitled "Guidelines for Assessing Applications for Programming Flexibility from Licensees of Radio Stations in Border Markets and Small Markets".
The Commission notes that the Brockville market has recorded a negative PBIT over the past five years, and that the population within the station's 3mV/m contour is less than 100,000. For these reasons, the Commission is satisfied that the applicant's request meets the guidelines for assessing applications for programming flexibility by radio station licensees serving small markets. The Commission is also satisfied that no other licensed radio stations would be adversely affected by the proposed change. Accordingly, the Commission approves the proposed amendment.
In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled "Implementation of an Employment Equity Policy", the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. It encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
