Following a Public Hearing in the National Capital Region beginning on 20 June 1994, the Commission approves the application for a broadcasting licence for an English-language FM radio programming undertaking consisting of CBVE-FM Quebec City and its transmitters CBMI-FM Baie-Comeau, CBMS-FM Blanc-Sablon, CBVB-FM Chandler, CBMD Chapais, CBVC-FM Chibougamau, CBJE-FM Chicoutimi, CBMP-FM Chisasibi, CBVA-FM Escuminac, CBMR-FM Fermont, CBVG-FM Gaspé, CBMU-FM Harrington Harbour, CBVM-FM Iles-de-la-Madeleine, CBMT-FM La Tabatière, CBME La Tuque, CBMO Lac Mégantic, CBMK Lebel-sur-Quévillon, CBMN Malartic, CBVS-FM Mistassini, CBMJ Murdochville, CBVN-FM New Carlisle, CBVR-FM New Richmond, CBMV-FM Old Fort Bay, CBVP-FM Percé, CBVF-FM Port-Daniel, CBMY-FM Rivière-Saint-Paul, CBMA-FM Rouyn-Noranda, CBMX-FM Saint-Augustin-Saguenay, CBMF-FM Saint-Jovite, CBDN Schefferville, CBMM Senneterre, CBSE-FM Sept-Iles, CBMB-FM Sherbrooke, CBMC-FM Thetford Mines, CBMZ-FM Trois-Rivières, CBML Val-d'Or, CBMQ-FM Waskaganish, CBVW-FM Waswanipi and CBMW-FM Wemindji. CBVE-FM will operate on the frequency 104.7 MHz, channel 284C1, with an effective radiated power of 100,000 watts.

In decision CRTC 94-611 of today's date, the Commission has renewed the licence for CBM Montréal and has approved CBC's request to delete authority to operate the above-mentioned transmitters as part of CBM's licence.

The Commission will issue a licence expiring 31 August 2000, subject to the conditions specified in this decision and in the licence to be issued.

The Commission notes that CBVE-FM will broadcast programming originating from the CBC English-language Radio (AM) network as well as 19 hours of local programming per week.

It is a condition of licence that the Corporation not broadcast any commercial message of Category 5 (Advertising) except:
|
(a) during programs that are available to the licensee only on a sponsored basis, or
|
(b) as required to fulfill the requirements of the legislation of the Parliament of Canada pertaining to elections, or
|
(c) in communities where there is no other programming undertaking broadcasting in the same language.
|
It is a condition of licence that 50% or more of the category 2 music selections broadcast each broadcast week be Canadian and that these selections be scheduled in a reasonable manner throughout the broadcast day.

It is a condition of licence that 20% or more of the category 3 music selections broadcast each broadcast week be Canadian.
|
It is also a condition of licence that the licensee adhere to its self-regulatory guidelines on sex-role portrayal as amended from time to time and approved by the Commission, and, as a minimum, to the Canadian Association of Broadcasters' "Sex-role Portrayal Code, for Television and Radio Programming", as amended from time to time and approved by the Commission.

In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled "Implementation of an Employment Equity Policy", the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. In the case of the Corporation, the Commission has addressed these matters in the decision renewing the CBC's television network licences.

The Commission acknowledges the supporting intervention submitted by Mrs. Paulette Losier.

In accordance with subsection 22(1) of the Broadcasting Act, the renewal of the authority for the transmitters CBMI-FM, CBMK, CBMJ, CBVF-FM, CBMB-FM, CBMC-FM and CBMZ-FM is subject to the issuance of Broadcasting Certificates by the Department of Industry, Science and Technology.
