New cable distribution undertaking
Following a Public Hearing in the National Capital Region beginning on 20 June 1994, the Commission approves the application by R193 Enterprises Ltd. for a licence to carry on a cable distribution undertaking to serve Big White Village. The operation of this undertaking will be regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations).
The Commission will issue a licence expiring 31 August 1997, subject to the conditions specified in this decision and in the licence to be issued. This term is consistent with the Commission's practice regarding the licensing of new cable distribution undertakings of this type.
The applicant is relieved, by condition of licence, of the requirement of paragraph 9(1)(d) of the regulations to distribute the CBC's regional television service CHBC Kelowna. The CBC has confirmed that CHBC's signal quality is technically unacceptable. Instead, the applicant will distribute the CBC Northern Television Service, received via satellite.
It is a condition of this licence that construction of this undertaking be completed and that it be in operation within twelve months of the date of this decision or, where the applicant applies to the Commission within this period and satisfies the Commission that it cannot complete implementation before the expiry of this period and that an extension is in the public interest, within such further periods of time as are approved in writing by the Commission.
The Canadian Broadcasting Corporation (CBC) submitted an intervention noting that, while the applicant is proposing to distribute the U.S. news service Cable News Network (CNN), it does not propose to distribute Newsworld, the CBC's news and information specialty service. The CBC stated that Newsworld was created to provide Canadians with a truly Canadian perspective of the news, and requested that cable operators wishing to offer CNN also distribute Newsworld.
The Commission has noted the applicant's response that it is not required by the regulations to distribute Newsworld rather than CNN. While the Commission notes that Newsworld is not a priority signal requiring mandatory carriage, it reiterates the importance of Canadian programming services being given the widest possible distribution.
