Decision

Ottawa, 22 April 1994
Decision CRTC 94-192
Alain Larivière
Saint-Cyprien, Quebec - 930953300
Licence renewal
Pursuant to Public Notice CRTC 1993-161 dated 23 November 1993, the Commission renews the licence held by Alain Larivière, for the cable distribution undertaking serving Saint-Cyprien, from 1 September 1994 to 31 August 2000. This term will enable the Commission to consider the renewal of this licence at the same time as that of other cable systems in the area.
The operation of this undertaking is regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions in effect under the current licence, as well as to those conditions specified in this decision and in the licence to be issued.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized to continue to distri-
bute CFJP-TV Montréal, received via satellite, as part of the basic service.
The Commission approves the licensee's request with respect to section 23 of the regulations. Accordingly, it is a condition of licence that the licensee be relieved of the requirement that it distribute at least four television programming services as provided for in section 23 of the regulations, so long as it distributes only the U.S. television service listed in the current application or as may subsequently be authorized by the Commission.
In approving this request, the Commission has taken into consideration the licensee's argument that the distribution of additional English-language CANCOM services is unwarranted because its subscribers are francophone. The Commission notes the intervention from Canadian Satellite Communications Inc. in this regard.
The Commission also notes the intervention by TVOntario objecting to the licensee's proposal to distribute "La Chaîne", received via satellite, and the licensee's reply to the intervention wherein it states that it does not distribute this service.
Allan J. Darling
Secretary General
