The Commission will hold a public hearing commencing on 14 February 1994 at 8:30 a.m., at the Conference Centre, Phase IV, 140 Promenade du Portage, Hull, Quebec, to consider the applications which are listed in the body of this notice.
|
RELATED DOCUMENTS: Public Notices CRTC 1993-74 and 1993-77 dated 3 June 1993, and 1993-77-1 dated 27 July 1993. These documents are available on request at any of the Commission's offices.
|
In Public Notice CRTC 1993-77 dated 3 June 1993, the Commission issued a call for applications for licences to carry on new specialty, pay television and pay-per-view programming undertakings. The deadline for the filing of applications was 3 September 1993. Subsequently, the Commission, in Public Notice CRTC 1993-77-1 dated 27 July 1993, extended the deadline for filing applications to 15 September 1993.

In Public Notice CRTC 1993-77-1, the Commission informed applicants and interested parties that in order for it to consider proposals at the earliest possible opportunity, it was imperative that applicants file complete proposals by providing all of the information requested in the application forms, giving special attention to the licensing criteria outlined in Public Notice CRTC 1993-77.

The Commission also stated that applications that did not contain all of the required information, as set out in Public Notice CRTC 1993-77-1, would be deemed incomplete and would be returned by the Commission.
|
|
The Commission later concluded that 19 of the proposals received in response to its call for applications were not complete and returned them on 19 October 1993 informing applicants that they could refile their proposals, at any time, for consideration at a later date. Furthermore, the Commission announced that four of these applications proposing to offer home-shopping and infomercial services raised significant policy issues and that they would thus be considered as part of a separate public process, details of which will be announced at a later date.

In its clarification process, the Commission indicated that applicants were required to limit their replies to the information requested and that any additional unsolicited information would be returned. In order to be fair to all applicants who replied to the 3 June call, a similar approach will be taken at the 14 February 1994 Public Hearing. The Commission wishes to advise applicants that no information will be accepted at the 14 February Public Hearing, other than that requested by the Commission.

On another matter, the Commission hereby informs applicants and interested parties that the Canadian Cable Television Association (CCTA) has submitted a document entitled "CCTA Report on Channel Capacity". The Commission has also written to the licensees of all Class 1 cable systems with more than 20,000 subscribers requesting information regarding their channel capacity. This report, along with the Commission's letters to the individual cable licensees and replies received, have been placed on the public file of the Public Hearing. Interested parties wishing to refer to this information in their written interventions are invited to do so.

In addition, the CCTA has issued for public comments on 12 November 1993, a document entitled "The Canadian Cable Television Association Access Commitment". The CCTA has asked for comment from all applicants at the 14 February Public Hearing, all existing specialty, pay television and pay-per-view licensees, all parties who appeared at the Commission's March 1993 Structural Hearing, federal and provincial governments, and national and provincial branches of the Consumers Association of Canada by 15 December 1993. This document is available from the CCTA which has committed to submit its final proposal to the CRTC before the February Hearing. The proposal will be subject to review as to its acceptability.

The Commission wishes to remind interested parties that they have the opportunity to provide their complete comments, in writing, concerning the applications under review, prior to 25 January 1994, which is the deadline for receipt of interventions. The Commission reiterates that all written interventions are considered when it makes its decisions.
|
|
Interveners requesting to appear at the public hearing will be required to provide reasons as to why their written interventions are not sufficient and an appearance is necessary. The Commission will inform interveners of whether their request to appear is granted.
|
|
As has generally been the Commission's practice, it will group the appearance of various inter- veners to particular applications at the same time to ensure the effective use of the public hearing time.
|
|
The Public Hearing process will consist of four phases. During Phase I, representatives for each item on the agenda will make a presentation of their applica- tion(s). Representatives for each item published herein will be permitted a maximum of 20 minutes for presentation at the public hearing. Representatives for each item published herein with two application numbers, offering separate English- and French-language services, will be permitted a maximum of 30 minutes for presentation at the public hearing.

Each presentation will be followed by a question period from Members of the Commission Panel. It is expected that nearly 15 days will be required to complete this phase.
|
|
In Phase II, the representatives for each item will be permitted a maximum of 10 minutes to present their oral interventions to all other applications. Subsequent to the prescribed deadline for receipt of interventions, applicants may file written interventions of up to 50 pages concerning all other applications, to be received on or before 3 February 1994.
|
|
Phase III will consist of the oral presentations by appearing interveners who will each be permitted a maximum of 10 minutes.
|
|
In Phase IV, representatives for each item will be permitted a maximum of 10 minutes to reply in the reverse order of appearance to all interventions made to their application. Applicants may also file written replies (providing 20 copies) concerning all interventions to their application, and totalling no more than 25 pages, during the public hearing.
|
|
NOTE: 1. The following terms may be used in the outlines of the applications listed below and in the public hearing process to describe the arrangements for cable system distribution proposed by the various applicants. Interested parties should refer to the applications in order to ascertain the details of the distribution arrangements which may expand upon the "generic" descriptions provided below.
|
|
- "mandatory basis" means mandatory distribution by all Class 1 and 2 cable licensees as part of the basic service on cable;
|
|
- "optional-to-basic basis" means optional distribution for each cable licensee as part of the basic service on cable;
|
|
- "discretionary basis" means distribution on either a stand alone basis, or as part of a discretionary package of services, and available to subscribers for a fee separate from and in addition to the basic monthly fee;
|
|
- "dual status basis" means distribution on an optional-to-basic basis, or with the consent of the service provider, on a discretionary basis,
|
|
