Licence renewal for CFTH-FM-1
|
Following a Public Hearing in Quebec City beginning on 4 May 1993, the Commission renews the broadcasting licence for CFTH-FM-1 Harrington Harbour from 1 September 1993 to 31 August 1997, subject to the conditions in effect under the current licence, as well as to those conditions specified in the licence to be issued. This four-year term will enable the Commission to assess at an early date the licensee's adherence to the Radio Regulations, 1986 (the regulations).

Subsections 8(5) and 8(6) of the regulations require each licensee to retain, for a period of at least four weeks from the date of broadcast, and furnish to the Commission upon request "a clear and intelligible tape recording or other exact copy of all matter broadcast".

In this regard, an analysis of the logger tapes for 21 May and 26 November 1992 revealed that the tapes were incomplete. The licensee explained that its limited financial and human resources precluded it from retaining the logger tapes of the programming originating from VOCM St John's, Newfoundland that it rebroadcasts. In its renewal application the licensee requested, for the reasons outlined above, to be relieved of the requirement to retain logger tapes of programming received over-the-air from other sources. The Commission is not prepared to grant an exemption from one of the most important provisions of the regulations applicable to community radio. Consequently, it denies the licensee's request. However, as stated in Public Notice 1986-248 announcing the 1986 regulations, the licensee of this part-time rebroadcaster could fulfil the requirements pertaining to logger tapes by submitting local programming on chronologically-labelled tapes recorded at the station and rebroadcast material on tapes provided by the originating station.

The Commission views with concern the licensee's non-compliance with this regulatory requirement. As stated in Public Notice CRTC 1993-122, of today's date, entitled "Compliance with the Provisions of the Radio Regulations, 1986 Relating to Logger Tapes", the Commission reminds licensees of the requirement to ensure the availability at all times of complete and intelligible logger tapes, and informs licensees that it intends to use all means available in ensuring that the Regulations are enforced in this regard.

The Commission approves the licensee's proposal to expand its broadcast week from 77.5 hours to 126 hours and to increase local program production from 28 to 32 hours per broadcast week.

The Commission also approves the application to amend the licence for CFTH-FM-1 by deleting the condition of licence limiting the station to a maximum of 20% of the broadcast time in advertising. In Public Notice CRTC 1992-38 dated 29 May 1992 entitled "Policies for Community and Campus Radio", the Commission announced that there will be no limit on advertising by Type A community radio stations. The Commission notes that the station will broadcast a minimum of 3% Category 3 music (Traditional and Special Interest) as a percentage of overall music programming.

In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled "Implementation of an Employment Equity Policy", the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. It considers that community radio stations should be particularly sensitive to this issue in order to reflect fully the communities they serve. It encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
