Acquisitions of assets
Following a Public Hearing in the National Capital Region beginning on 27 September 1993, the Commission approves the application by the partners of Maclean Hunter Cable TV Niagara, a partnership (MHCN), for authority to acquire the assets of the cable distribution undertaking serving Niagara Falls, Welland, Port Colborne, Fonthill and area from Maclean Hunter Cable TV (Niagara) Limited, and for a broadcasting licence to continue the operation of this undertaking.
The Commission also approves MHCN's application for authority to acquire the assets of the cable distribution undertaking serving St. Catharines from Maclean Hunter Limited, and for a broadcasting licence to continue the operation of this undertaking.
The Commission will issue licences to MHCN expiring 31 August 1996, the current expiry date, upon surrender of the current licences. The operation of these undertakings will be regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations). The authorities granted herein are subject to the conditions in effect under the current licences, as well as to any other condition that may be specified in this decision and in the licences to be issued.
The Commission notes that the transactions proposed within these applications represent intra-corporate reorganizations that do not alter the control or management of the licensees. As a result of these intra-corporate transactions, the partners of MHCN will consist of Maclean Hunter Cable TV (Niagara) Limited (50%) and Maclean Hunter Limited (50%).
Both undertakings
The licensee is relieved, by condition of licence, of the requirement of section 9 of the regulations to distribute the French-language educational television programming service operated by TVOntario, "La Chaîne" on the basic band (channels 2 to 13). The Commission notes that the licensee will continue to distribute this service as part of the basic service.
Niagara Falls, Welland, Port Colborne, Fonthill and area
Pursuant to paragraph 10(1)(j) of the regulations, the licensee is authorized to continue to distribute, at its option, the programming services of WGRZ-TV (NBC), WIVB-TV (CBS) Buffalo, New York and WJET-TV (ABC), Erie, Pennsylvania, received over-the-air, as part of the basic service. The Commission notes that these signals have been distributed on the undertaking for many years.
Consistent with Decision CRTC 92-459 dated 9 July 1992, the licensee is authorized to continue to distribute, pursuant to paragraph 10(1)(j) of the regulations, the programming service of WNEQ-TV (PBS) Buffalo, received over-the-air, so long as it does not distribute the signal of WQLN (PBS) Erie.
St. Catharines
Consistent with Decision CRTC 91-721 dated 4 September 1991 and pursuant to paragraph 10(1)(j) of the regulations, the licensee is authorized to continue to distribute, at its option, the programming services of WIVB-TV (CBS), WKBW-TV (ABC) and WGRZ-TV (NBC) Buffalo, received over-the-air, as part of the basic service. The Commission notes that these signals have been distributed on the undertaking for many years.
