New cable distribution undertaking
Following a Public Hearing in Moncton beginning on 17 February 1993, the Commission approves the application by Coopérative Inter Câble de St-Isidore for a licence to carry on a cable distribution undertaking to serve part of Sagard.
The applicant has requested the addition of a condition of licence authorizing it to act as a Part III licensee under the applicable section of the Cable Television Regulations, 1986 (the regulations). In light of the small size of this undertaking, which will serve a low-density community of approximately 35 households, the Commission authorizes the applicant, by condition of licence, to act as a Part III licensee.
The operation of this undertaking will be regulated pursuant to Parts I and III of the regulations. The Commission will issue a licence expiring 31 August 1995 subject to the conditions specified in this decision and in the licence to be issued. This term is consistent with the Commission's practice regarding the licensing of new cable distribution undertakings regulated pursuant to Parts I and III of the regulations. The Commission approves, by condition of licence, the applicant's request to be relieved of the requirement of section 22 of the regulations to distribute the priority services of CIMT-TV and CKRT-TV Rivière-du-Loup, CFRS-TV Jonquière, CBJET Chicoutimi and CIVB-TV-1 Grand-Fonds.
In approving this application, the Commission has taken into account a technical report from the Department of Communications, which confirmed that the reception quality of these signals is not reliable.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the applicant is authorized to distribute CFTM-TV, CBFT, CFJP-TV and CIVM-TV Montréal, received via satellite, as part of the basic service.
The Commission approves the applicant's request with respect to section 23 of the regulations. Accordingly, it is a condition of licence that the applicant be relieved of the requirement that it distribute at least four television programming services delivered to its local head end by a network operator licensed to extend television and radio services to remote and underserved communities, at least one of which must be a Canadian television programming service, so long as it does not distribute any U.S. television services.
In approving this request, the Commission has taken into account the applicant's argument that the community that will be served is entirely francophone and that its residents have no interest in receiving English-language services. The Commission notes the intervention from Canadian Satellite Communications Inc. in this regard.
It is a condition of this licence that construction of this undertaking be completed and that it be in operation within twelve months of the date of this decision or, where the applicant applies to the Commission within this period and satisfies the Commission that it cannot complete implementation before the expiry of this period and that an extension is in the public interest, within such further period of time as is approved in writing by the Commission.
