THE NEW BRUNSWICK TELEPHONE COMPANY LIMITED - RATE OF RETURN ON AVERAGE COMMON EQUITY FOR 1993

Background
|
In a letter to The New Brunswick Telephone Company Limited (NBTel) dated 14 July 1992, the Commission noted, among other things, that it had not as yet formally adjudicated on an appropriate rate of return on average common equity (ROE) range for the company. The Commission stated that it would issue a public notice initiating a proceeding to establish an appropriate range for 1993.

In accordance with its announced intention, the Commission initiates a proceeding to address issues related to a fair and reasonable ROE and ROE range for NBTel for 1993. This proceeding will focus only on issues related to an appropriate ROE, and not on the company's revenue requirement for 1993.

In order to reach an expeditious conclusion, the Commission will in this proceeding depart from its traditional procedures for reviewing a company's ROE. The procedures established below will permit a complete examination of issues related to NBTel's ROE, while allowing the Commission to issue a decision in an appropriate timeframe for the company to incorporate the approved ROE into its 1993 forecast.

Procedure

1. Persons wishing to participate in this proceeding (interveners) must file a notice of intention to participate with the Commission, serving a copy on NBTel, by 25 August 1992. Interveners should indicate in that notice whether they intend to file evidence in the proceeding. The Commission will issue a complete list of parties and their mailing addresses.

2. By letter dated 24 July 1992, the Commission has addressed interrogatories to NBTel. The company has been directed to file its responses by 14 August 1992. By the same date, NBTel is to serve copies of its responses on interveners who have already notified it of their intention to participate. The company is also directed to serve copies on interveners who register after 14 August 1992 forthwith upon receipt of a notification of intention to participate.

3. NBTel's evidence must be filed with the Commission and served on interveners by 8 September 1992. Interveners filing evidence are to file that evidence by the same date, serving copies on NBTel and on other interveners.
|
4. Parties may address interrogatories to NBTel and to interveners who have filed evidence. Any such interrogatories must be filed with the Commission and served on the party in question by 22 September 1992.
|
5. NBTel and interveners to whom interrogatories have been addressed are to file their responses with the Commission, serving copies on all other parties, by 13 October 1992.

6. NBTel is to file argument with the Commission, serving copies on all interveners, by 23 October 1992.
|
7. Interveners are to file argument with the Commission, serving a copy on NBTel, by 2 November 1992.
|
8. NBTel is to file reply argument with the Commission, serving copies on all interveners, by 9 November 1992.
|
9. Where a document is to be filed or served by a specific date, the document must be actually received, not merely mailed, by that date.
