Pursuant to Public Notice CRTC 1992-69 dated 8 October 1992, the Commission approves the application by Mitchell-Seaforth Cable T.V. Ltd. to amend the licence for the cable distribution undertaking serving Mitchell, Seaforth and surrounding area, by adding a condition of licence allowing the licensee to distribute, at its option, the programming service of CHCH-TV Hamilton, received via satellite from the CANCOM network, as part of the basic service.
Paragraph 9(1)(i) of the Cable Television Regulations, 1986 (the regulations) requires the licensee to distribute CHCH-TV, an extra-regional signal, received over the air. The licensee has indicated however that the over-the-air reception quality of this signal is poor because of the distance from the licensee's head end to the CHCH-TV transmitter. Accordingly, the licensee proposes to distribute CHCH-TV, received via satellite from the CANCOM network.
In view of the foregoing, the licensee is relieved, by condition of licence, from the requirement of paragraph 9(1)(i) of the regulations that it distribute CHCH-TV, received over the air.
