Following a Public Hearing in Quebec City beginning on 19 May 1992, the Commission renews the broadcasting licence for the radio programming undertaking consisting of CIHO-FM Saint-Hilarion and its transmitters CIHO-FM-1 La Malbaie and CIHO-FM-2 Rivière-du-Gouffre, from 1 September 1992 to 31 August 1994, subject to the conditions specified in the licence to be issued.
This term will enable the Commission to assess the licensee's performance in response to the concerns outlined below.
Subsections 8(5) and 8(6) of the Radio Regulations, 1986 (the regulations) require each licensee to retain, for a period of at least four weeks from the date of broadcast, and furnish to the Commission upon request "a clear and intelligible tape recording or other exact copy of all matter broadcast".
In this regard, the Commission requested the station's logger tapes of the programming broadcast during the week of 17 to 23 March 1991. Following this request, the licensee admitted that 7 hours were missing from both the 22 March and 23 March tapes. An analysis of the programming broadcast on 21 March indicated that 11 minutes were missing from the logger tape. The licensee informed the Commission that these problems were due to improper tape handling or to technical problems with the recording equipment. In addition, the licensee's self-analysis report indicated that while its commitment for category 3 music was for 6 hours 34 minutes per week, only 2 hours 15 minutes had been broadcast. The licensee explained that it had been unable to purchase the necessary discs, due to financial problems.
The Commission views with great concern the licensee's failure to comply with the provisions of the regulations relating to logger tapes and to adhere to the commitments outlined in its Promise of Performance. It intends to monitor closely the licensee's performance during the new licence term, and directs the licensee to take all necessary measures to ensure that the regulations and the licensee's commitments are adhered to at all times.
The Commission reminds the licensee that it is required to adhere to its commitment not to broadcast more than 8 minutes of advertising per hour and to refrain from soliciting advertising on the south shore of the St. Lawrence River. The licensee is also reminded that, while CIHO-FM is licensed as an independent FM broadcasting undertaking, it is essentially a community-owned and community-oriented station.
The Commission reaffirms the particular importance it attaches to the development of Canadian talent and notes the level of the licensee's commitment in this regard.
The Commission notes the intervention submitted by the Association des radiodiffuseurs communautaires du Québec in support of this application.
