Following a Public Hearing in Edmonton beginning on 5 May 1992, the Commission approves the application by Northern Native Broadcasting (Terrace, B.C.) (NNB) for a broadcasting licence for an English- and Native- language FM radio programming undertaking at Terrace.

Pursuant to Public Notice CRTC 1990-89 dated 20 September 1990 entitled Native Broadcasting Policy, the Commission will issue a licence for a Type B FM native radio station. This licence will expire on 31 August 1998 and will be subject to the conditions specified in this decision and in the licence to be issued.

The Commission notes that the station will broadcast 126 hours per week of programming, of which 116 hours will be in English and 10 hours will be in various native languages such as Haida, Gitksan and Nisga'a. The programs will originate part-time from NNB's studios at Terrace, as well as part-time from Native Communications Society of the Western N.W.T.'s studios at Yellowknife (CKNM-FM), Northern Native Broadcasting, Yukon's studios at Whitehorse (CHON-FM) and the Aboriginal Multi-Media Society of Alberta's studios at Lac La Biche (CFWE-FM). The Commission notes that NNB will rebroadcast the program service approved herein through its low-power FM radio transmitters located throughout northern British Columbia. The Commission also notes that this new radio programming undertaking will provide all of the programming currently broadcast by NNB's radio network.

The Commission acknowledges the important role played by NNB in meeting the linguistic and cultural needs of the native population of northern British Columbia.

The applicant is reminded of the recently implemented amendments to the Radio Regulations, 1986, which set out requirements for a minimum level of Spoken Word programming and Canadian musical selections.

It is a condition of licence that the applicant broadcast no more than an average of 4 minutes of advertising per hour per day, with a maximum of 6 minutes in any given hour, in accordance with the native radio policy for Type B stations.

It is a condition of licence that the applicant adhere to the guidelines on sex-role portrayal set out in the Canadian Association of Broadcasters' (CAB) Sex-Role Portrayal Code for Television and Radio Programming, as amended from time to time and approved by the Commission.

It is also a condition of licence that the applicant adhere to the provisions of the CAB's Broadcast Code for Advertising to Children, as amended from time to time and approved by the Commission.

Since NNB will operate a radio programming undertaking consistent with the procedures outlined in Public Notice CRTC 1991-63 entitled "New Broadcasting Act - Amendments to Classes of Licence", it will no longer require a licence to operate a radio network. Accordingly, the licence for the radio network will lapse and become null and void on its expiry date, 30 September 1992.

As well, in view of the fact the distribution undertaking CFNR Terrace and its transmitters will form part of the programming undertaking approved herein, no further action is required on NNB's application (910939800) announced in Public Notice CRTC 1991-87 dated 23 August 1991, for the renewal of the licence for CFNR and its transmitters VF2110 Blueberry River, VF2111 Burns Lake, VF2112 Doig River, VF2113 Fort Ware, VF2114 Iskut, VF2115 Kincolith, VF2116 Kitimat, VF2117 Kitkatla, VF2118 Kitwancool (Gitanyow), VF2119 Metlakatla and VF2120 Telegraph Creek.

In a related decision released today (Decision CRTC 92-481), the Commission approved applications by NNB for broadcasting licences for English- and Native- language FM radio programming undertakings to distribute the programming services of NNB and some locally-produced programming at communities located throughout northern British Columbia.
