Grasslands FM, a limited partnership

Pursuant to Public Notice CRTC 1992-14 dated 12 February 1992, the Commission renews the broadcasting licence for CIMG-FM Swift Current from 1 September 1992 to 31 August 1994, subject to the conditions specified in this decision and in the licence to be issued.
This term will enable the Commission to assess at an early date the licensee's compliance with the Radio Regulations, 1986 (the regulations) and the FM policy.
Subsections 8(5) and 8(6) of the regulations require each licensee to retain, for a period of at least four weeks from the date of broadcast, and furnish to the Commission upon request "a clear and intelligible tape recording or other exact copy of all matter broadcast".
The broadcasting licence for CIMG-FM was last renewed in Decision CRTC 90-819, dated 29 August 1990. The renewal period was for two years only, following a public hearing at which was discussed, among other things, the licensee's failure to provide logger tapes. In Decision CRTC 90-819, the Commission noted the licensee's statement at the hearing that it was then operating in full compliance, and had taken steps to ensure that it remained in compliance. During the current term of licence, the Commission requested the station's logger tapes of the programming broadcast during the week of 17 to 23 February 1991. The licensee was unable to provide the logger tape for 21 February. In a letter dated 23 September 1991, Grasslands FM explained that the station had experienced some technical difficulties, but that significant improvements to the logging equipment were made upon discovery of the malfunction. The licensee also stated that it had introduced new procedures to ensure compliance in this regard.
The Commission views with concern the licensee's non-compliance with this regulatory requirement and intends to monitor the licensee's performance during the new licence term. The Commission directs the licensee to demonstrate that it has taken all necessary measures to ensure that it complies at all times with the provisions of the regulations relating to logger tapes.
Consistent with Decision CRTC 90-819, it is a condition of licence that Grasslands FM, as licensee of CIMG-FM, have unrestricted and exclusive use of the assets of the station, with the general partner (Grasslands Broadcasting Ltd.) acting solely as manager for the partnership. It is also a condition of licence that the nature and composition of the partnership not be altered without the prior approval of the Commission.
The Commission reaffirms the particular importance it attaches to the development of Canadian talent. As part of its renewal application, the licensee indicated that it was unable to make a commitment in direct expenditures to Canadian talent development because of the station's financial difficulties. The Commission will expect the licensee to make direct cost contributions to the development of Canadian talent once the station achieves a positive operating income. It is a condition of licence that the licensee adhere to the guidelines on sex-role portrayal set out in the Canadian Association of Broadcasters' (CAB) Sex-Role Portrayal Code for Television and Radio Programming, as amended from time to time and approved by the Commission.
It is also a condition of licence that the licensee adhere to the provisions of the CAB's Broadcast Code for Advertising to Children, as amended from time to time and approved by the Commission.
The Commission acknowledges the intervention received from the CAB in support of this application.
