REVISED LISTS OF ELIGIBLE SATELLITE SERVICES
INTRODUCTION
Attached to this Public Notice are revised lists of "Part II Eligible Satellite Services" (Part II list) and "Part III Eligible Canadian Satellite Services" and "Part III Eligible Non-Canadian Satellite Services" (Part III list). The Part II list contains satellite services authorized for distribution by licensees holding Class 1 and Class 2 licences and is found in Appendix A. The Part III list contains satellite services authorized for distribution by licensees holding Part III licences and is found in Appendix B.
In Public Notice CRTC 1991-45, dated 29 April 1991, the Commission invited comments on a request by First Choice Canadian Communications Corporation (First Choice) to add KTLA Los Angeles and The Comedy Network (now known as "Comedy Central") to Section "B" of the Part II list. The revisions to the lists announced today result from the Commission's consideration of comments received in response to that notice. The Commission received comments from 18 parties, and all of these have been taken into consideration by the Commission. The Commission thanks those parties for their participation in this process.
1.KTLA Los Angeles
KTLA Los Angeles is an independent station providing classic and current movies, sports and syndicated series programming.
The Canadian Cable Television Association (CCTA), individual cable licensees and the pay television networks supported the addition of KTLA Los Angeles to Section "B" of the Part II list.
The Sports Network (TSN) opposed the addition of KTLA Los Angeles to the list, on the basis that its programming would compete directly with programming on TSN.
It is the Commission's view that the programming format of KTLA Los Angeles is similar to that provided by several other superstations currently on the list. In addition, the Commission notes that services on Section "B" of the Part II list may be packaged only with Canadian pay television services, and therefore should not have any undue impact on Canadian specialty services.
Accordingly, the Commission is adding KTLA Los Angeles to Section "B" of the Part II list and, for consistency, to the Part III list. 2.Comedy Central
Comedy Central is a 24-hour satellite service providing programming that includes stand-up acts, sketch variety programs, game shows, and syndicated series.
The CCTA, individual cable licensees, and the pay television networks supported the addition of Comedy Central to Section "B" of the Part II list.
Norstar Entertainment Inc., a Canadian film and television production and distribution company, opposed the addition of Comedy Central to Section "B" of the Part II list, noting that it has been examining the potential for a Canadian comedy programming service and intends to apply to the Commission for a licence to provide such a service. Noting that it would be difficult to establish a competing Canadian service if a U.S. service were already available, it suggested that the Commission should defer consideration of this matter for at least three years.
With respect to Norstar's submission, the Commission notes that the Commission's policy, as outlined in Public Notice CRTC 1987-261, dated 30 November 1987, states that:
 ...should the Commission license, in the future, a Canadian service in a format competitive to an authorized non-Canadian specialty service, the authority for the cable carriage of the non-Canadian service could be terminated. Rogers Cable T.V. Limited (Rogers) suggested that Comedy Central should be added to Section "A" of the Part II list, thereby making it available for linkage with either pay television or specialty services.
Considering that the Commission requested comments on the addition of Comedy Central to only Section "B" of the Part II list, the Commission is of the view that it would be inappropriate to add this service to Section "A" of the Part II list, as affected parties did not have the opportunity to comment on Rogers' proposal.
The Commission will therefore add Comedy Central to Section "B" of the Part II list and, for consistency, to the Part III list.
3.Other Matters
Pursuant to CRTC Circular Letter No. 377, dated 5 June 1991, the Commission authorized cable licensees to distribute only the 6:00 a.m. to 7:00 p.m. (ET) Monday to Friday programming component of CNBC/FNN. A note reflecting this restriction is being included on both the Part II and Part III lists.
Also, the previous Part II and Part III lists contained a note stating that the authorization to distribute The Financial News Nework (FNN) does not include the programming of FNN:Sports. As a result of CNBC's purchase of FNN, the programming service of FNN:Sports has been discontinued. This note has therefore now been deleted.

29 April 1991; in the case of CANCOM signals, ASN, the CBC English- and French-language Television Services and U.S. satellite services, licensees are required to enter into the necessary contractual arrangements for such carriage;* pursuant to CRTC Circular Letter No. 377, dated 5 June l99l, licensees are authorized to distribute only the 6:00 a.m. to 7:00 p.m. (ET) Monday to Friday programming component of CNBC/FNN.

Authorization for the above-noted services is subject to the following: when these lists of Part III Eligible Satellite Services are replaced by other lists of Part III Eligible Satellite Services, the only authorized services will be those contained in the most recent lists; accordingly, these lists supersede the list of Part III Eligible Canadian Satellite Services and the list of Part III Eligible Non-Canadian Satellite Services dated 29 April 1991; in the case of out-of-province educational services, there should be no objection on the part of the originating service; in the case of CANCOM signals, ASN, and the CBC English- and French-language Television Services, licensees are required to enter into the necessary contractual arrangements for such carriage; in the case of CFTM-TV and CHAN-TV, a licensee also distributing the signal of a local TVA/CTV affiliate shall delete the duplicate programming from the CANCOM services or substitute the local service(s) when the programming is identical;-iii -
