NEWFOUNDLAND TELEPHONE COMPANY LIMITED - CABLE SUPPORT STRUCTURE ARRANGEMENTS FOR CABLE-TELEVISION LESSEES

In Newfoundland Telephone Company Limited - Revenue Requirement for the Years 1990 and 1991 and Attachment of Customer-Provided Multi-line Terminal Equipment, Telecom Decision CRTC 90-15, 12 July 1990 (Decision 90-15), the Commission noted that Newfoundland Telephone Company Limited (Nfld Tel) was providing pole line attachment service under separate agreements and that those agreements had not been filed for the Commission's approval. The Commission directed Nfld Tel to file proposed tariff pages with respect to the provision of pole line attachment service. In accordance with the Commission's direction in Decision 90-15, Nfld Tel has filed proposed amendments to its Non-Basic Services Tariff providing for Cable Support Structure Arrangements for Cable-Television Lessees. The proposed revisions specify rates for each pole, each 100 metres of strand and each duct-metre of conduit.

Nfld Tel states in its application that the rates proposed for Region 1 of its operating territory (which comprised Nfld Tel's entire operating territory prior to its amalgamation with Terra Nova Telecommunications Inc. on 1 January 1989) are based on the method for calculating pole attachment rates approved by the Board of Commissioners of Public Utilities of Newfoundland and Labrador, Nfld Tel's former regulator. Nfld Tel states that such rates are based on its costs and on the costs of the electric utility with which a joint use pole agreement exists, and are calculated annually using data as of 31 December of the previous year. Nfld Tel notes that it currently has joint use agreements with Newfoundland and Labrador Hydro for poles in Labrador and with Newfoundland Light & Power Co. Ltd. for poles elsewhere in Region 1. Therefore, two separate pole attachment rates are calculated for Region 1.

Nfld Tel states that the rates proposed for Region 2 of its operating territory are those approved by the Commission in 1987, when that area comprised the operating territory of Terra Nova Telecommunications Inc. The proposed rates are based on the rating method set out in Support Structure and Related Items - Public Proceeding on Rates, Telecom Decision CRTC 86-16, 15 August 1986 (Decision 86-16).

In Telecom Order CRTC 90-1521, 31 December 1990, the Commission granted interim approval to Nfld Tel's proposed tariff pages. However, the Commission wishes to consider the use of a single rating method, specifically, that method currently applied in Region 2, to establish support structure rates applicable throughout Nfld Tel's operating territory. The Commission invites public comment on this and related issues in accordance with the procedures set out below.

(1) Interested persons wishing to participate in this proceeding (interveners) must file a notice of intention to participate with the Commission and serve a copy on Nfld Tel by 1 March 1991. The Commission will issue a complete list of parties and their mailing addresses.

(3) Nfld Tel is directed to file with the Commission, by 12 April 1991, a cost study and suggested rates using the support structure rating method set out in Decision 86-16. Copies are to be served on interveners by the same date.

(4) Interveners may address interrogatories to Nfld Tel. Any such interrogatories must be filed with the Commission and served on Nfld Tel by 3 May 1991.

(5) Nfld Tel's responses to any interrogatories must be filed with the Commission and served on interveners by 31 May 1991.
|
(6) Requests by interveners for further responses to their interrogatories, specifying in each case why a further response is both relevant and necessary, and requests for public disclosure of information for which confidentiality has been claimed, setting out the reasons for disclosure, must be filed with the Commission and served on the company by 7 June 1991.

(7) Nfld Tel's written responses to requests for further responses to interrogatories and requests for public disclosure of information must be filed with the Commission and served on the intervener making the request by 14 June 1991. The Commission will issue a decision with respect to requests for further responses and for public disclosure as soon as possible thereafter.

(8) Interveners may file comments with the Commission, serving copies on Nfld Tel, by 12 July 1991.

(9) Nfld Tel may file reply comments with the Commission, serving copies on the interveners, by 26 July 1991.
|
(10) Where a document is to be filed or served by a specific date, the document must be actually received, not merely mailed, by that date.
