PROPOSED AMENDMENTS TO THE CABLE TELEVISION REGULATIONS, 1986

The Commission announces that it proposes to make the attached amendments to the Cable Television Regulations, 1986 (the regulations).

The proposed amendments include:
a revised definition of the term "basic monthly fee", contained in section 2 of the regulations; and a revision to subsection 18(3) of the regulations.

Revision to section 2
|
The proposed amendment to the definition of the "basic monthly fee" was requested by the Canadian Cable Television Association (CCTA). The purpose of this amendment is to clarify that cable licensees may charge a monthly fee for each additional cable outlet installed in a subscriber's home, whether or not a terminal device is connected to the outlet.

The Commission notes that the amendment, as proposed by the CCTA, would be consistent with long-standing industry practice respecting additional cable outlet charges.

Revision to subsection 18(3)
|
In accordance with subsection 18 (3.1) of the regulations, where a licensee has increased its pass-through portion pursuant to subsection 18(3) with respect to a specialty service and ceases to distribute that service as part of the basic service, the licensee is required to decrease its pass-through portion by an amount equal to the amount of the increase.

In order that there be consistency in the treatment of wholesale fees charged for programming services other than specialty services to which subsection 18(3) of the regulations applies, the Commission proposes to amend subsection 18(3) by adding the requirement that a cable licensee reduce its basic monthly fee where it ceases to distribute such a service as part of the basic service, or where the wholesale fee charged to the licensee by a third party for such a service is reduced.
