Following a Public Hearing in the National Capital Region held on 5 March 1991, the Commission renews the Class 1 licence for the cable distribution undertaking serving the communities noted above, held by Halton-Triangle Investments Limited, from 1 October 1991 to 31 August 1996. The operation of this undertaking is regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions specified in this decision and in the licence to be issued.
Consistent with Decision CRTC 87-279, the licensee is relieved, by condition of licence, of the requirement of paragraph 9(1)(b) of the regulations to distribute the French-language educational programming service operated by TVOntario ("La Chaîne française") on the basic band (channels 2 to 13). The Commission notes that the licensee will continue to distribute this service as part of the basic service. The licensee is relieved, by condition of licence, of the obligation of section 12 of the regulations that it distribute the signals of CKCO-TV Kitchener, and CBLT and CFMT-TV Toronto on unrestricted channels. Should the quality of the signals deteriorate significantly, the licensee will be expected to undertake immediate corrective action such as moving the services to other channels.
On 13 May 1986, the Commission approved administratively the licensee's application to extend its authorized service area to include Campbellville and area. However, the Commission notes that the licensee has not yet implemented service to this area. The Commission expects the licensee to extend service to Campbellville during the first year of the new licence term. Accordingly, the authority to serve the Campbellville area is valid until 30 September 1992 only, at which time this authority will lapse and become null and void, unless service to the Campbellville area has been implemented by that date, in which case, this authority will continue for the duration of the licence term.
The Commission reaffirms the particular importance that it attaches to the development of community programming and has taken note of the annual budgets which will be allocated for this purpose during the new licence term. The Commission encourages the licensee to continue its efforts to develop community programs that reflect subscriber interests and concerns. The Commission acknowledges the intervention by M.W. Fielding regarding this application and the licensee's reply thereto.
