Southmount Cable Limited

Following a Public Hearing in the National Capital Region held on 5 March 1991, the Commission renews the Class 1 licence held by Southmount Cable Limited, for the cable distribution undertaking serving the communities noted above, from 1 October 1991 to 31 August 1996. The operation of this undertaking is regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions specified in this decision and in the licence to be issued.
The licensee is relieved, by condition of licence, of the requirement of section 12 of the regulations that it distribute the signals of CKCO-TV Kitchener and CBLT Toronto on unrestricted channels. Should the quality of the signals deteriorate significantly, the Commission expects the licensee to undertake immediate corrective action including, if necessary, the distribution of these services on other channels. Pursuant to paragraph 10(1)(j) of the regulations, the licensee is authorized to continue to distribute, at its option, the programming services of WIVB-TV (CBS), WKBW-TV (ABC) and WNED-TV (PBS) Buffalo, New York, received over-the-air, as part of the basic service. The Commission notes that the licensee has been distributing these signals on its system for many years.
The Commission reaffirms the particular importance it attaches to the development of community programming and has taken note of the annual budgets which will be allocated for this purpose during the new licence term. The Commission expects the licensee to increase its community programming budget to ensure that, in each year of the new licence term, this budget meets the 5% bench mark level established by the Commission.
The Commission acknowledges the intervention received from the Regional Municipality of Hamilton-Wentworth in support of this application.
