Following a Public Hearing in Vancouver beginning on 3 October 1989, the Commission renews the Class 2 (fewer than 2,000 subscribers) licence for the cable distribution undertaking serving Kingsgate, held by Kingsgate Community Association, from 1 September 1992 to 31 August 1995.
The operation of this undertaking is regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations) and the licence is subject to the conditions specified in this decision and in the licence to be issued.
The licensee is relieved, by condition of licence, of the requirement of section 9 of the regulations to distribute, as part of the basic service, the Knowledge Network, regional station CBUCT-2 Creston, British Columbia and the programming service of a French-language television station owned-and-operated by the Canadian Broadcasting Corporation and distributed to the licensee via satellite or microwave relay. The Commission notes that there is no local or regional station distributing such CBC programming. In granting the licensee an exemption from the regulatory requirement that it distribute these services, the Commission has taken into consideration the fact that this is a small undertaking serving approximately 15 subscribers and that it is not economically viable for the licensee to provide the services noted above.
The Commission also approves the licensee's request to be relieved, by condition of licence, of the requirement of paragraph 9(1)(g) of the regulations to distribute community programming on the community channel. Consistent with the Commission's new community channel policy announced in CRTC Public Notice 1991-59, dated 5 June 1989, the Commission expects the licensee, as a minimum, to provide its subscribers with a local alphanumeric service.
The Commission reminds the licensee that pursuant to section 11 of the regulations it is required to devote a greater number of the video channels of its undertaking to the distribution of Canadian programming services than to the distribution of non-Canadian programming services.
