Winnipeg Videon Incorporated

Following a Public Hearing in Regina beginning on 23 October 1990, the Commission renews the Class 1 licence for the broadcasting receiving undertaking serving part of Winnipeg, held by Winnipeg Videon Incorporated (Videon), from 1 September 1991 to 31 August 1996. The operation of this undertaking is regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions specified in this decision and in the licence to be issued.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized, by condition of licence, to continue to distribute, at its option, WDIV-TV (NBC) and WJBK-TV (CBS) Detroit, Michigan, received via satellite from the CANCOM network, as well as the Silent Network, received via satellite, as part of the basic service.
The licensee is also authorized to continue to distribute, at its option, KGFE (PBS) Grand Forks and WDAZ-TV (ABC) Devils Lake, North Dakota, received via microwave, as part of the basic service, as well as the audio programming services of KNOX-FM Grand Forks and WDAY-FM Fargo, North Dakota, received via microwave, on audio channels of the undertaking.
Further, Videon is authorized to continue to distribute, at its option, the following special programming services, without advertising material: National Film Board documentaries, video programming presented in co-operation with non-profit Manitoba tourism groups, Manitoba Department of Education programming, native programming supplied by Native Communications Inc., the Racetrack Management (1983) Network, received via satellite, Videon local productions, pay television promotional material and a cable menu service.
The licensee is authorized, by condition of licence to replace, at its option, the programming of WJBK-TV, with the signal of CKND-TV Winnipeg, during the Jerry Lewis Muscular Dystrophy Telethon for the September 1991 Labour Day Weekend broadcast.
It is a condition of licence that Videon ensure that its agreement with Greater Winnipeg Cablevision Limited to operate and share in the ownership and control of a distant head end located at Tolstoi, Manitoba continues to be in force and effect, and that future and existing licensees are afforded the opportunity to participate in the use of the distant head end on an equitable basis. The licensee is authorized, by condition of licence to continue to distribute until 30 September 1991, the Question Period of the Manitoba Legislature on the community channel, when community programming is not being distributed on this channel. Should the scheduling of the Manitoba Legislature programming conflict with the community programming, the licensee will be expected to undertake immediate corrective action, such as moving the service to another channel. After 30 September 1991, Videon will distribute this programming on its special programming channel, VSP7.
The Commission reaffirms the particular importance that it attaches to the development of community programming and notes Videon's projected expenditures for this purpose. The Commission commends Videon for the excellent community programming services provided on its community channel and on its special programming channel and encourages it to continue its support for the production of community programs that reflect subscriber interests and concerns.
In a related decision released today (Decision CRTC 90-45), the Commission approved Videon's application for a network licence to provide special educational and information programming to cable undertakings in Manitoba.
