Following a Public Hearing in the National Capital Region held on 5 March 1991, the Commission renews the Class 2 licence for the cable distribution undertaking serving Parry Sound, held by Radio & T.V. Distribution Limited, from 1 October 1991 to 31 August 1996. The operation of this undertaking is regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions specified in this decision and in the licence to be issued.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized, by condition of licence, to continue to distribute, at its option, CICI-TV Sudbury, Ontario, received over-the-air, as well as CHCH-TV Hamilton and WXYZ-TV (ABC) and WTVS (PBS) Detroit, Michigan, received via satellite from the CANCOM network, as part of the basic service.
The licensee is also authorized to continue to distribute, at its option, WIVB-TV (CBS) and WGRZ-TV (NBC) Buffalo, New York, received via microwave, as part of the basic service. Consistent with Decision CRTC 87-378, the licensee is relieved, by condition of licence, of the requirement of paragraph 9(1)(b) of the regulations to distribute the French-language educational television programming service operated by TVOntario ("La Chaîne française") on the basic band (channels 2 to 13). The Commission notes that the licensee will continue to carry this service as part of the basic service.
The Commission also notes that the licensee does not distribute a CBC French-language television service. In addition, the Commission has noted the licensee's statement that no such local or regional service is available in the area. Nevertheless, the Commission reminds the licensee that it is required by paragraph 9(1)(f) of the regulations to distribute, as part of the basic service, the programming service of a French-language television station owned-and-operated by the CBC and distributed to the licensee via satellite or microwave relay, in the absence of a local or regional station distributing such programming. The licensee is therefore required to take immediate corrective measures in order to distribute a CBC French-language television service by satellite or microwave and to confirm to the Commission, within three months of the date of this decision, that it has complied with the requirements of the regulations.
The Commission reaffirms the particular importance that it attaches to the development of community programming and has taken note of the annual budgets which will be allocated for this purpose during the new licence term. The Commission encourages the licensee to continue its efforts to develop community programs that reflect subscriber interests and concerns.
