Coopérative de câblodistribution de la Base de Moisie

Following a Public Hearing held in the National Capital Region on 28 May 1991, the Commission approves the application by the Coopérative de câblodistribution de la Base de Moisie for a licence to carry on a cable distribution undertaking to serve Moisie. The operation of this undertaking will be regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations).
The Commission will issue a licence expiring 31 August 1993, subject to the conditions specified in this decision and in the licence to be issued. This term will enable the Commission to review the operations of this undertaking at an appropriate time.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the applicant is authorized to distribute CFJP-TV Montréal, received via satellite, as part of the basic service. The Commission approves the applicant's request with respect to section 23 of the regulations. Accordingly, it is a condition of licence that the applicant be relieved of the requirement that it distribute at least four television programming services delivered to its local head end by a network operator licensed to extend television and radio services to remote and underserved communities, at least one of which must be a Canadian television programming service, so long as it does not distribute any U.S. television station.
In considering the above request, the Commission has taken into account the applicant's argument that this community is predominantly French speaking and that there is very little interest for English-language programming.
In accordance with subsection 22(1) of the Broadcasting Act, the Commission will issue a licence to the applicant if it is in receipt of written notification from the Department of Communications (DOC), within six months of the date of this decision, that it will issue a Broadcasting Certificate. No licence will be issued if the Commission does not receive this notification within said period or, where the applicant applies to the Commission and satisfies the Commission that it is unable to obtain said notification before the expiry of this six-month period and that an extension of this period is in the public interest, within such further period of time as is approved in writing by the Commission.
It is a condition of licence that the authority granted herein be implemented within twelve months of the date of receipt of written notification from the DOC that it will issue a Broadcasting Certificate or, where the applicant applies to the Commission and satisfies the Commission that it cannot implement its authority before the expiry of this twelve-month period and that an extension of this period is in the public interest, within such further period of time as is approved in writing by the Commission.
