Télé-Câble St-Hilarion Inc.

Following a Public Hearing in Quebec City beginning on 5 March 1991, the Commission approves the application by Télé-Câble St-Hilarion Inc. for a licence to carry on a broadcasting receiving undertaking to serve Saint-Hilarion. The operation of this undertaking will be regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations).
The Commission will issue a licence expiring 31 August 1995, subject to the conditions specified in this decision and in the licence to be issued. This term will enable the Commission to consider the renewal of this licence at the same time as that of other cable systems in the area.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the applicant is authorized to distribute CFJP-TV Montréal, received via satellite, as part of the basic service.
The Commission notes that the applicant proposes to distribute CFTM-TV Montréal as well as a TVA affiliate, CIMT-TV Rivière-du-Loup. In this regard, the applicant has indicated that it would delete from CFTM-TV any programming identical to that of CIMT-TV.
The Commission approves the applicant's request with respect to section 23 of the regulations. Accordingly, it is a condition of licence that the applicant be relieved of the requirement that it distribute at least four television programming services delivered to its local head end by a network operator licensed to extend television and radio services to remote and underserved communities, at least one of which must be a Canadian television programming service, so long as the applicant continues to distribute the services listed in the current application.
In approving this request, the Commission has taken into account the applicant's statement that its subscribers, who are French speaking, have no interest for English language services. The Commission acknowledges the intervention filed in this regard by Canadian Satellite Communications Inc.
The Commission also acknowledges the intervention filed by Cablovision Plus Inc. opposing this application and has taken into account the applicant's reply thereto.
