CNCP TELECOMMUNICATIONS - TARIFF REVISIONS ASSOCIATED WITH MACH III SERVICE
Reference: Tariff Notice 539
The Commission has received an application from CNCP Telecommunications (CNCP), dated 30 April 1990, for approval of tariff revisions for its Mach III Service. CNCP proposed the following: (1) the introduction of new fractional DS-1 bandwith options (256 kbps, 384 kbps, 512 kbps and 768 kbps); (2) the introduction of DS-2 bandwith availability; (3) a discount structure for transport charges, based on the customer's term of service; and (4) DS-1 access charges identical to those filed by Bell Canada (Bell) under Tariff Notices 3420 and 3420A, and by British Columbia Telephone Company (B.C. Tel) under Tariff Notices 2056, 2056A and 2056B.
In its application, CNCP stated that its proposed rates would not maintain the 5% differential between rates for its services and those for comparable Bell and B.C. Tel services, as approved by the Commis-sion in CNCP Telecommunications - Mach III Service and Related Matters, Telecom Decision CRTC 88-17, 7 October 1988 (Decision 88-17). In support of its rate proposals, CNCP stated that the market has changed since Decision 88-17 was issued in that customers expect greater pricing innovation zand flexibility. CNCP submitted that, therefore, the Commission's directions with respect to the 5% differential do not sufficiently address the current Competitive Network services market.
CNCP requested that the Commission grant interim approval to Tariff Notice 539, with the exception of its proposed Customer Volume Payment Plan, which provides for term discounts applicable to transport charges and intercity termination charges. CNCP also suggested that the Commission grant interim approval to Bell Tariff Notices 3420 and 3420A, and to B.C. Tel Tariff Notices 2056, 2056A and 2056B, with the exception of proposed revisions providing for comparable discounts.
In Telecom Order CRTC 90-493, dated 10 May 1990, the Commission denied CNCP's request for interim approval. The Commission stated that, in light of the issues raised by CNCP's application, including the proposed elimination of the 5% rate differential, it would be inappropriate to consider approval of the application, even on an interim basis, without the benefit of a public process.
The Commission invites comment on the issues raised by CNCP's application. The procedures to be followed in connection with this proceeding are set out below.

3. Interested persons wishing to participate in this proceeding (interveners) must file a notice of intention to participate with the Commission and serve a copy on CNCP by 11 June 1990. The Commission will issue a complete list of parties and their mailing addresses.
4. Interveners may address interrogatories to CNCP. Any such interrogatories must be filed with the Commission and served on CNCP by 11 June 1990.
5. CNCP's responses to any interrogatories must be filed with the Commission and served on interveners by 3 July 1990.
6. Requests by interveners for further responses to their interrogatories, specifying in each case why a further response is both relevant and necessary, and requests for public disclosure of information for which confidentiality has been claimed, setting out the reasons for disclosure, must be filed with the Commission and served on CNCP by 18 July 1990.
7. CNCP's written responses to requests for further responses to interrogatories and requests for public disclosure of information must be filed with the Commission and served on interveners by 25 July 1990.
8. The Commission will issue directions as to further procedure once a decision has been made with respect to any requests for further responses or for public disclosure of information.
9. Where a document is to be filed or served by a specific date, the document must be actually received, not merely mailed, by that date.
