Following a Public Hearing in the National Capital Region beginning on 5 July 1990, the Commission renews the broadcasting licence for CIRX-FM Prince George and its rebroadcaster CIRX-FM-1 Vanderhoof from 1 September 1990 to 31 August 1992, subject to the conditions specified in this decision and in the licence to be issued. This term will enable the Commission to assess at an early date the licensee's compliance with the Radio Regulations, 1986 (the regulations) and the FM policy. It will also enable the Commission to consider the renewal of this licence at the same time as that of other FM stations in the area following the review of FM policy announced in Public Notice CRTC 1990-20 dated 16 February 1990.
In Decision CRTC 89-459 dated 14 July 1989, the Commission renewed the licence for CIRX-FM and CIRX-FM-1 for a period of only one year in light of the non-compliance problems related to the unauthorized shift to a Group IV music format, the continued high level of hits despite the present short-term renewal for shortcomings in this area of its performance, the shortfall in category 6 musical (Traditional and Special Interest) selections, and with regard to the provision of complete logger tapes.
The Commission has undertaken an analysis of the station's programming during the week of 1 to 7 October 1989 and determined that the station is operating in its authorized Group I format and in compliance with respect to the level of hits. The Commission noted, however, compliance problems with respect to the provision of complete logger tapes and a shortfall in category 6 music selections.
Subsections 8(5) and 8(6) of the regulations require each licensee to retain and furnish to the Commission upon request 'a clear and intelligible tape recording or other exact copy of all material broadcast' for a period of at least four weeks from the date of broadcast.
In this respect, the licensee was unable to provide the Commission with complete and audible logger tapes for the programming between 6:00 a.m. and 6:00 p.m. on 1 October 1989 due to a volume control problem in an amplifier. The licensee has advised that it has installed preset volume controls in order to ensure that this problem does not reoccur.
The Commission reiterates the importance of ensuring that appropriate measures are taken to make certain that its regulations are adhered to at all times.
The Commission approves the proposed reduction in category 6 programming from 8 hours to 6 hours weekly and a decrease in the level of spoken word programming from 24 hours 42 minutes to 17 hours 35 minutes per week, which will still allow the licensee to provide an acceptable level of such programming to its audience.
The Commission also approves the licensee's request to reduce the percentage of time devoted to foreground programming from 20% to 15% per week.
The licensee is reminded that it must ensure that the commitments outlined in its Promise of Performance are adhered to at all times and that the Commission will closely monitor the licensee's performance in this regard during the new licence term.
The Commission reaffirms the particular importance it attaches to the development of Canadian talent and is satisfied with the annual budgets allocated and the initiatives proposed by the licensee in this respect. It encourages the licensee to continue its efforts in this regard during the new licence term and to develop new initiatives for the support, development and on-air exposure of local and regional talent.
It is a condition of licence that the licensee adhere to the Canadian Association of Broadcasters' (CAB) self-regulatory guidelines on sex-role stereotyping, as amended from time to time and approved by the Commission.
It is also a condition of licence that the licensee adhere to the provisions of the CAB's Broadcast Code for Advertising to Children, as amended from time to time and approved by the Commission. The Commission notes the four interventions in support of the renewal of CIRX-FM's licence.
