Following a Public Hearing in Halifax beginning on 21 November 1989, the Commission approves the applications by N1 Cable TV Ltd. for licences to carry on broadcasting receiving undertakings to serve the communities noted above. The operation of these undertakings will be regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations). The Commission will issue licences expiring 31 August 1994, subject to the conditions specified in this decision and in the licences to be issued.

An intervention has been received from TVOntario objecting to the applicant's proposal to distribute TVOntario programming (CICA-TV Toronto), received via satellite, on each undertaking. The Commission draws to the applicant's attention that, pursuant to the regulations and as set out in the list of "Part III Eligible Canadian Satellite Services" (Appendix to Public Notice CRTC 1989-102), the distribution of out-of-province educational services not receivable over-the-air is only authorized subject to the requirement that there be no objection on the part of the originating service. In light of TVOntario's objection, the Commission is not prepared to approve the proposed distribution of CICA-TV.

The Commission reminds the applicant that it is required to submit, both to the CRTC and to the Department of Communications (DOC), its proposed head end co-ordinates as well as documentation regarding the proposed sites for these head ends for each of the undertakings for the purpose of technical certification. No licence will be issued in respect of an undertaking until such technical certification is issued by the DOC.

It is a condition of each licence that construction of the undertaking be completed and that it be in operation within twelve months of the date of receipt of written notification from the DOC that it will issue a Broadcasting Certificate or, where the applicant applies to the Commission within this twelve-month period and satisfies the Commission that it cannot complete the construction and begin the operation of the undertaking before the expiry of this period and that an extension is in the public interest, within such further period of time as is approved in writing by the Commission.
